ROGERS, Ark. (AP) — A northwest Arkansas father has sued the Rogers School District, challenging the one-day suspension his 5-year-old son received for using a curse word at school.

Ken Swindle filed the lawsuit Tuesday against the Rogers School District and Anita Turner, the principal of Northside Elementary School. Swindle, an attorney, says he learned earlier Tuesday that his son had been suspended for using the profane word.

Swindle tells the Benton County Daily Record the school overreacted and that his son didn't understand the meaning of the word. He says he's concerned the suspension will leave a "permanent mark" on the boy's school records.

He's asking a judge to require the district's school board to hold a full hearing on the suspension.

The district could not be reached for comment early Wednesday.

He is 5, the school should be sued. What did they teach him, he can stay home and have fun. The schools go way overboard on stupid petty stuff. I hope all involved get fired.

THIS IS EXTREME MEASURES AGANIST A 5 YEAR OLD. I SAY IF IT IS THE FIRST TIME THEY SHOULD INFORM THE PARENTS AND IF IT CONTINUES THEN THEY MAY TAKE STRONGER MEASURES.

Words consist of definition and sounds. Where is the crime? Show me the injury. (Botcha is a vulgar word in one of the 5 languages spoken in Rhodesia. So now you can't say it anymore. From now on "blue" is profane. You must say "azure" or get fired.)

The matter of where he heard it is small. Dad should watch his mouth in front of son is a big joke too. You can't keep them in the closet forever. He could of heard it on TV, Radio, in the play yard at school. This was just something the father needed to do to show how stupid we have become with our rule making. All the money for grants and education should be cut. I don't see anyone getting any smarter.

Well 5 yr olds should learn early that cussing is not appropriate in school, no respect for his elders and that's why he was caught cussing by the teacher.....Had it been my kid, I would understand why he was suspended and then I would have washed his little mouth out with a bar of soap after he got home. Maybe twice so he'd never forget it! If you do bad things then punishment follows! I hope this stupid father wastes every penny he has on this frivolous lawsuit

School officials should spend more time protecting our children from their very own staff, as well as, from weapons! STOP THE NONSENSE of suspending a kindergarten student for a "curse" word! And again....what higher being determines what a "curse" word is anyway? WE make it taboo....GROW UP!!
