AG sets new lawsuit proceeds policy

LITTLE ROCK, Ark. (AP) — The Arkansas Attorney General's office has set new policy on how consumer protection lawsuit settlements or judgments are distributed.

Talk Business reported on its website Thursday that Attorney General Dustin McDaniel made the change in an Oct. 11 memo. McDaniel has been criticized for using settlement dollars without legislative approval.

In the memo, McDaniel wrote tha funds would be distributed in four ways.

The first would direct proceeds toward restitution to consumers or state agencies as designated by the court order or settlement agreement. Next, funds would be designated to a state agency connected to the litigation.

The third manner would pay attorney's fees to the state treasury and the fourth involves a payment into the Consumer Education and Enforcement account.

McDaniel's spokesman didn't immediately return a message seeking comment.
