LITTLE ROCK, Ark. (AP) — Lawyers who tried to obtain documents under Arkansas' public records law say a lower court erred when it said the documents were exempt from the Freedom of Information Act.
The lawyers and attorneys for the doctors they're suing are expected to make their case in front of the Arkansas Supreme Court on Thursday.
Luther Sutter's firm requested documents in a medical malpractice case and later sued when the attorneys didn't get them. A lower court said the documents were exempt under an exception about competitive disadvantage.
Sutter says the state's highest court ought to interpret the public records act broadly and overturn the lower court's decision.
The doctors and their attorneys say the documents requested aren't public records covered by the Freedom of Information Act.
