This is one of the many problems within the justice system. There are to many loopholes in the way the laws are written, therefore the criminals fall between the cracks and escape justice. But, the main problem within the justice system is that the system is not set up to provide justice to victims or to protect their rights. It is set up and carried out to cater to the criminals. A jury convicts and the judge sentences within the guidelines, but a small, very small fraction of the sentence is ever served. Dont relate it to prison overcrowding, because the prisons are overcrowded due to the justice system being weak and there is no threat to the criminals. They get a mild slap on the wrist for a major crime, so where is the lesson to be learned? There isnt one. Make examples out of the criminals and make prison a feared place to be, not a 6 month vacation from crime.
