HOT SPRINGS, Ark. (AP) — Oral arguments are planned in a federal lawsuit filed by a group of Malvern parents who are challenging a provision of the state's school-choice law that factors in race when students wish to transfer to a new district.

The case will go before U.S. District Judge Barry Bryant at 1 p.m. Monday in Hot Springs. The parents are seeking an injunction that would allow the children to enroll in the Magnet Cove School District.

The lawsuit claims the children have been or will be denied admission into Magnet Cove because they are white. The state says the law is necessary to protect desegregation efforts.

In this case, state law barred the transfer because the Malvern district is about 60 percent white and the Magnet Cove district is 95 percent white.

I hope this terrible law gets struck down. We are in the process of trying to sell our house and move because the district our kids are in is underperforming. However, because we are white and the neighboring district to which we wish to transfer is majority white, they can not transfer under the School Choice Act. It is nothing but reverse discrimination that is negatively impacting the education of children throughout the state.

If the role was reversed and there was a chance that black kids would be denied entry to a school, we would have a nationally recognized racial lawsuit on our hands.

You can't have it both ways either race is not a factor or it is. If you can't discriminate because they are black then the same applies to being white. This is clearly a discrimination at its worst and unconsititutional.
