If you've been the victim of malpractice, you're entitled to be compensated for any damages you incur as a direct result of negligence. One type of damage you can be compensated for is damage to your business. Damages to your business might include lost profits, in which case you'd need to prove that your business lost net profits, not gross profits. Sometimes it might be difficult to assign an amount to lost profits; you don't have to prove it mathematically, just with 'reasonable certainty.' You also might be entitled to compensation for the loss of goodwill based on your company's name, location, reputation, and accomplishments. The damages to your business that qualify for compensation can vary by state, so contacting an attorney can help ensure that you're aware of the guidelines in your area.
