Workers' Compensation laws are generally a comprehensive system for employees whose employers carry and are covered under workers' compensation insurance. If an employee is injured on the job, recovery for statutory benefits should be available from the employer. The employee should be able to recover medical expenses and disability payments without having to show fault. However, a 'trade-off' exists because the employee is usually prevented from suing the employer in court if the employer is covered by workers' compensation insurance.
