BENTON, AR - More questions surrounding the Benton School District and the quality of care it's developmentally disabled students receive.

This after another parent comes forward to FOX16 with allegations their student was mistreated at an elementary school.

We introduced you to 6-year old Janiya Carter on Monday. The kindergartner is in a full leg cast suffering from a broken femur that her mom believes she received while at Caldwell Elementary last month.

Erica Horne saw our story, got online on the FOX16 Facebook site and contacted us.

"I don't believe their goal was to educate my children," Horne says.

Horne says her Autistic sons Dylan and Darrin no longer attend Benton schools, her family moving to Bryant. She says because of repeated verbal abuse towards her boys by staff at Caldwell. Horne says she filed a complaint with the Department of Human Services.

"The lady at DHS told me since Dylan could not talk himself, there was nothing they could do," Horne says.

DHS won't talk about any investigation, but Benton Schools refute Horne's claims, citing a department of education formal hearing that found the complaints without foundation, ruling in favor of the district.

"I feel our standard of care for every student is more than adequate,” superintendent Dan Jordan says. “We have a professional staff that do a good job each and everyday.”

Horne says her final year in Benton was actually a positive experience, but still decided to move her sons into Bryant schools.

As far as Janiya Carter's broken leg, investigators with Benton Police say they're still investigating along with the school district.

Once again it is someone talking who doesn't understand. That is a completely differnt kind of suite that had to be filed seperatley. We never wanted money or anything or we could have got that when they lost one of the boys and they did not he was gone until the stranger who found him in their house brought him back to school. We wanted better services not only for our two but all kids. That is why Benton had to bring in outside services to better equip their staff and the aide who we did not mention was removed from the classroom. We have stated not all are bad just a few but it is the lack of them being handled correctly as the problem. Their final year after the service gained by the settlement was brought in and the corrupt indviduals removed from THAT classroom things went great.

If your child was abused, why was that not a part of the lawsuit?

The Horne's case was an educational suite not an abuse case. Actually no judgement was found a settlement was found. All that was asked and awarded was better practices and education for the teachers at the school. That is why outside education and observations were brought in. So once again Dan Jordan was not fully truthful possibly becaus his own wife was on the recordings.

I think the school needs to be closed and all of the teachers need to be charged as a child abuser for the little girls leg being broken I bet the truth will come out then.

Thank GOD for your story Mrs. Horne because Caldwell Elementary keeps covering up everything, just like Dan Jordan once again told another BOLD FACE LIE saying that the staff are good caring people but he sitting up at the Administration office saying he knows his staff, no wonder they have not gave him that position he can`t be trusted.
