LITTLE ROCK, Ark. --
In a six page ruling, Associate Justice Karen Baker writes, "The right to a fair and impartial trial is a fundamental guarantee, and Conway was denied that right in this case."That case she's referring to is the one where a Garland County jury found Conway guilty of capital murder back. During the trial, records show that one juror told the court "I don't think i can be a fair juror anymore."
Defense attorneys made a motion to have that juror dismissed, but the court denied it.
"The pictures, the hearing about it -- we have to relive this all over again, and it's not like we're going to trial for one family member, but five family members," Karen Gentry McNeely told FOX16 over the phone.
The victims in that murder are Karen Gentry McNeely's family members, specifically her father, brother, sister-in-law, nephew, and her nephew's girlfriend.
She said the healing process had just begun after the sentencing.
"I feel it should have been handled at that time but it doesn't mean he's not guilty. It doesn't mean he wasn't judged by his peers," McNeely said.
But even though she's out of state, she'll be back -- no matter now gruesome or how depressing the details are.
"I have to be there. My dad would be there for me. My brother would be there for me. It's something that I have to do as a family member," McNeely said.
