Ark. judge weighs in on West Memphis evidence case

LITTLE ROCK, Ark. (AP) - The mother of one of three Cub Scouts killed in northeast Arkansas in 1993 cannot see physical evidence in her son's death under the state's Freedom of Information Act, a judge has ruled.

The judge issued the decision in a lawsuit Pam Hicks filed in the hopes of viewing evidence in the 1993 slaying of her son, 8-year-old Stevie Branch, and his friends, Michael Moore and Christopher Byers.

Hicks argued that police and prosecutors violated the Freedom of Information Act by not allowing her to examine items, including her son's bicycle and clothing.

Circuit Judge Victor Hill disagreed and said in an order filed late Monday that neither the West Memphis Police Department nor prosecutor Scott Ellington violated the Freedom of Information Act.

"These items might be available for viewing under some other provision of the statutory or common law, which plaintiffs are free to argue at a later hearing, but these items are not available to them under the Freedom of Information Act," Hill wrote in an order filed late Monday in Crittenden County.

The Associated Press obtained a copy of the letter from the court Tuesday before either the West Memphis attorney or Hicks's lawyer had seen it.

Hicks' lawyer, Ken Swindle, said late Tuesday that he respectfully disagreed with the judge's decision, but he pointed out that the judge hadn't completely closed the door on the case.

Being a believer in God and the Bible; I'd say justice will eventually be served to the real killer(s). Someone mentioned "Law Abiding Citizen" in another post. If it had been my son; well, I can't say anything about those that covered it up; use your imagination.

i do agree with you there minds made up to cover their butts but i also think the mother does have a right to see all to do with case its her son dead if it was mine id keeping kicking thaT DOOR AN RAISEING HELL TILL SOMETHING WAS DONE IF IT WAS YOUR SON WOULDNT YOU

I agree with Butch, stop pissing away money on a horse thats been beaten to a pulp. I am so sick and tired of hearing about the WM3, the WMPD, the prosecutor, the release of the WM3, the debacle of a case that this is. There will never be a conviction in the murders. There will never be justice served to the family of those 3 boys that were killed. Its time to move on and learn from this f' up. I'm sorry for the parents and families of the 3 boys that died, but they will never know the truth, unfortunately, due to some idiots in charge of the investigation.

This has turned into a gallery of jokes looking for their 15 minutes of fame. The result will always be questioned. There are no answers that will satisfy everyone. It is what it is. A black stain on our elected officials in that time and area. Quit wasting tax dollars and court time.

I'll say it again. The black man with blood all over him in the food joint. Police "lost" the evidence they collected. Two guys ran off to CA just after the murders, and one confessed; but later recanted; WMPD didn't follow up on them. And then there was stepdaddy; last one seen talking to the boys, last one seen with them. My main suspect. The WM3 were taken down because it was an easy wash job. God will take care of the creep(s) that really did this when their time comes.

CROOKED POLICE RAN A BARNEY FIFE INVESTAGATION AN PROSCUTERS AN JUDGES GETTING RICH JUSTICE WAS NOT DONE IN THIS CASE BUT THAT HARD TO DO WHEN KEYSTONE COPS HANDLING CASE

I agree, something is being hidden....or the STARs are still paying the police, prosecuter, and whoever!!! Not saying the 3 guys are guilty but somthing is really screwery!!!
