Couples File Suit Challenging Arkansas Marriage Laws

LITTLE ROCK, AR -- Three couples have filed a federal lawsuit challenging the constitutionality of Arkansas marriage law, known as Amendment 83.

Pulaski County Clerk Larry Crane, Governor Mike Beebe and Attorney General Dustin McDaniel are listed as defendants in the suit.

The suit, filed Monday, says the plaintiffs seek a declaration that Amendment 83 violates the right to equal protection and due process of law under the 14th amendment to the U.S. Constitution.

It cites the recent overturning of a key section of the Defense of Marriage Act (DOMA), in which the U.S. Supreme Court found that section 2 of DOMA violated the Equal Protection and Due Process clauses in the fifth amendment of the U.S. Constitution.
