Man says he bought stolen gun at gun show, now faces felony

LITTLE ROCK, AR -- A Little Rock man claims he bought a gun from a gun show, but he had no idea it was stolen. Now the man is will go to jail on a felony charge if he doesn't find the gun's receipt.

Kenneth Lee says Little Rock police pulled him over Friday for loud music and when they searched his car, they found his gun.

Lee does have a license to carry the gun. But when police ran the serial number, it came back stolen.

"I have never had this problem before," said Lee.

Lee says he bought the gun at a local gun show, paying $350 for it. However, he can't find the receipt.

"It had my name, the seller's name, and all of that," said Lee.

Without the receipt, police took him to jail on a theft by receiving charge, which could be upgraded.

"I am trying to find me a lawyer now. So I can get it all settled and done. I'm just trying to get it behind me," said Lee.

Jim Mitchell manages gun shows in Central Arkansas. He doesn't have any connection to Lee's case. But warns consumers to complete a bill of sale form to protect yourself.

"Its incumbent on both people, the buyer and the seller, to make sure to keep track of who they buy it from and who they sell it too," said Mitchell.

Lee is now warning other buyers.

"Be careful and save all your receipts. That's all that matters. As long as you got that receipt, you are okay."

Maybe so wpsark, I do agree with you that Pawn Shops are the biggest distrubutors of stolen merchandise and should start getting charged when identified and caught.

Good point wps. I would hope that if he was smart enough to go through the process of being able to legally carry a weapon, that he wouldnt buy a stolen one. All I'll say is someone is lying in this story, and it will be soon told who.

why don't pawn shop owners get charged with theft by receiving?..They buy stolen crap all of the time. Guzzler, the guy is responsible enough to have his conceal carry, surely he wouldn't be dumb enough to knowingly buy a stolen gun.

alfisher, if you had read my comment, you would have a better understanding of where I'm coming from. I said he did go about the process of getting the license. If given a receipt, he should have had it stuck away some place in case this ever came up. Anyone that purchases any firearm should have common sense enough to save the proof of the purchase. I'm not calling you an idiot, but just stating that its better to cover your ass than to leave it hanging out to get spanked.

I wish people knew more about how the law worked in cases just like this. They have the report of it being stolen. That is the courts burden of proof. In front of the judge then it switches to your burden to prove not by you. Darn where is that reciept. Or find the guy who sold it to you and get him to appear. When buying a used gun get a DL. number on the reciept and take it to the sheriff office and check it. Safe thing to do. Better than jail. Inconvence, yes. Which is better though. Butch is real sick and down. Hopes to be up giving all fits soon. Love to all.

I'm curious. What about guns handed down to you by your father, grandfather, etc.? Need a reciept?

Typical BS story, he knows the gun was HOT but conveniently cannot find the receipt.

itsjustme, people do throw away receipts in time, I've purchased ammo, rifles, etc, for the different hunting seasons here in the state and I'm pretty sure I can't find most of those receipts 2 months after the hunting season ends. I think our court systems should just take the fire arm in this case b/c obviously this guy didn't steal it, he did take the time to legally get certified to carry the weapon in the first case, seems to me someone wanting to steal a handgun would have skipped the process of wanting to carry it legally to begin with.

PGH412, these gun shows are suppose to follow the same federal laws and guidelines that any other retailer has to. They are suppose to do the proper paperwork to make sure felons are not trying to buy guns. They are suppose to issue receipts, etc. Whether or not if that was the case here, who knows. Not everyone selling guns at these gun shows are honest enough to do whats right. The fact that this guy has a license to carry the gun, does give some credibility to his story. But why didnt he keep his receipt if it wasnt stolen? Anyone with common sense knows to keep records of legitimate firearm transactions, especially for instances like this.
