No charges in Diamondhead Police shooting

The man who shot a Diamondhead police officer will not face any criminal charges. The prosecutor's office says the use of deadly force by homeowner Jerry Chambliss is justified.

Chambliss tells David Goins about his plans to file new legal action against Officer Fred Ensminger.

Newly released 911 tapes show the chaos inside the Diamondhead gated community on July 21st.

1st Call:
Cindy Nelson: "This guy with a badge just tried to run my husband over.  Oh my god (screaming), he's shooting at us!  Oh my god!!"

2nd Call:
Dispatch: "911?"
Fred Ensminger: "This is Diamondhead 1106."
Dispatch: “Yes."
Ensminger: "I have been shot and I need medical at my front gate ASAP."

That's Officer Fred Ensminger's voice minutes after Diamondhead resident Jerry Chambliss shot him. Police didn't arrest Chambliss that night. He claimed he shot in self defense.

The Garland County prosecutor agrees. In a 12-page report released Friday, prosecutor Steve Oliver concludes Chambliss was justified in shooting the officer in order to protect his wife.

And that statements made by Ensminger about what happened are contradicted by other witnesses and evidence.

FOX16 News showed Chambliss the report today and only one thing surprised him - the fact that no charges will be filed against Fred Ensminger.

"It's ludicrous," Chambliss says.

We wanted to get officer Ensminger's reaction to the prosecutor's decision but he wasn't home.

"Just because he has a badge he does not have the right to come down and try to kill citizens," Chambliss says.

Chambliss says Ensminger never identified himself. The report addressed agreed, saying the officer never used a light or siren in his personal vehicle. And that Ensminger used poor judgment by aggressively pursuing Chambliss's wife through the gated community minutes before the two fired on each other.

"Every time a car pulls out behind me, we look to see if it is him," Chambliss says.

Chambliss says he and his wife still relive every moment of the shootout in their front yard.

“You get through something like this but you'll never get over it,” Chambliss says. “You'll never get over this."

Decertified and barred from law enforcement? That's the penalty for a guy who tries to kill two innocent people and then submits a perjured report attempting to pin the crime on the innocents? Sheesh! I'm glad I don't live around there. They have an armed and dangerous maniac lurking around and financed by the taxpayers. When will police be held accountable for outrageous behavior such as this. Behavior which is becoming commonplace. The police are NOT your friends. They are dangerous, volatile and unaccountable. The only difference between the police and street gangs is sometimes the street gangsters go to jail for their crimes.

Ensminger should immediately be decertified and barred from law enforcement forever more, everywhere!! Had I been Mr. Chambliss, I'd have blown his damn head clean off. Yeah, I agree, sue Ensminger clear back into the stone age. Crooked cops are everywhere and they're never held responsible for their crimes, they get a free pass.

Forget kennyvision sue him till he can't walk. everyone will try to dismiss under rule 12 B 6 which is an admission of liability in his individual capacity. Take him for every dime he is worth. He is a waste of good air.

Mr. Chambliss , you had your chance at being judge , jury , and executioner , so I don't see how you can be upset that he is not being held accountable . The general public may be outraged at this miscarraige of justice , but , well , you had your chance .

If he had been anyone other than a police officer, Ensminger would be facing attempted murder charges. Why do corrupt policemen continue to get a free pass from the justice system? I hope Chambliss takes them to the cleaners in court.
