LITTLE ROCK, Ark. (AP) — There's no settlement in a federal lawsuit filed by the family of a man who was fatally shot when two off-duty Little Rock police officers checked on him at his apartment.

Lawyers for the officers and for two sons of Eugene Ellison met with a judge Wednesday for four hours but came to no resolution.

Police said after Ellison was killed in 2010 that two officers were working security at an apartment complex and entered Ellison's apartment to check on him. The officers said Ellison attacked them and one drew her pistol and shot him.

One of Ellison's sons is a Little Rock police officer and another teaches criminal justice in Texas. They have asked the Justice Department to investigate and also sued the city and the apartment complex.

He had a gun with him. I guess you think the black man that walked back into the store and killed the black woman will turn his life around too? A lot of good that will do her children!

I dont think anyone is asking for your sympathy aryankee. If the family sue.Im sure they will be asking for $$$ and could careless about what or who you have sympathy for. That kid was no saint but did not deserve to die like that.So many people have broken the law...learned their lesson and went on to lead normal lives.I've heard of alot of Pastors, drug counselors and mentors talk about how they've lived in the past and how they are doing this or that to better themselves and the community. We will never know what he could have done in his lifetime because his life was taken away by someone who was suppose to protect and serve.

Didn't the original story say he attacked them with a cane? One would think two "professional" police officers would be able to subdue an elderly man with a cane without using deadly force. Hope the family wins big on this one. As for the "kid"; he wasn't a career criminal in the making, he was already one. It was only a matter of time before he killed an innocent person in is chosen profession. No sympathy here.
