Police: Burglary suspect shot and killed in fight with detective

LITTLE ROCK, AR – A burglary suspect was shot and killed by a Little Rock detective Friday morning after police say the suspect fought with the detective and tried to grab his gun.

"We can get called to anything at anytime and there is a certain unpredictability there. You just have to look at your situation and you have to take stock of yourself and move forward. You can't overreact," said Chief Stuart Thomas.

Little Rock police say the incident started when detectives were dispatched to investigate a call where a home was broken into and the suspects had returned to remove property from it.

Detectives searched the area and found the burglary around 9:40am at a duplex located at 4521 W. 16th Street. Police say the detectives found a man loading items taken from the home into a gray Toyota Camry being driving by a second person.

Police say detectives followed the Camry while they requested help from a marked police car. Prior to the marked unit arriving, the Camry stopped just west of 1418 S. Brown Street and the suspects got out of the car and ran.

Detectives gave chase. According to police, one suspect feigned surrendering, then charged at the detective. During the ensuing fight, the detective was thrown to the ground. Police say the suspect “attempted to take control” of the detectives handgun. A second detective pursing the suspects saw this and shot the suspect.

Michael W. Daniel, Jr., 25, was pronounced dead at the scene. The second suspect, Marcus Davis, 26, was arrested without incident by police officers in the area. Davis is charged with capital murder, burglary, theft, and fleeing.

Police say two investigations will be conducted into this incident. The first will be done by LRPD’s Major Crimes Division, who will submit their work to the prosecuting attorney’s office for review and determination of compliance with Arkansas law. The second will be done by LRPD’s Department of Professional Standards, who will determine if the detectives acted within LRPD’s policies.

Per policy, both detectives were placed on administrative leave.

I wasn't there, so I don't know the story. Have to rely on the police, and eyewitnesses ( that may be biased against the police considering the neighborhood ). I do know this - one less thief to worry about, and I hope the capital murder sticks so another thief is off the streets for good. Can't stand people that take from honest hard working folk.

if you're involved in a crime and someone dies, you're held responsible - if you weren't committing the crime, the death wouldn't have happened. therefore, the death is as a result of your committing the crime, and you are held responsible, same as you'd be responsible for damages to property (for instance). (and this is the generic You - not you specifically...)

I'm glad they caught the scum. But it's hard for me to understand how capital murder charges can be filed against the second suspect just because the officer shot the first. That's like me getting a speeding ticket as a passenger if the driver was doing the speeding,

SO WHAT IF HE WAS SHOT IN THE BACK....IT WAS A DETECTIVE OBSERVING WHAT WAS GOING ON THAT SHOT HIM. WOULD YOU EXPECT THE DETECTIVE TO SAY "HEY YOU, TURN AROUND SO I CAN SHOOT YOU FACE TO FACE"....HE SHOULD NOT HAVE BEEN DOING WHAT HE WAS DOING IF HE DIDN'T WANT TO RISK HIS FATE.

And RADAD...let's see you sing the same tune about "less lethal" when you are on the receiving end of something like that. If you have never walked in a cop's shoes and put up with the crap that they put up with... I would advise you to take the advise of Mark Twain who said, "Better to keep your mouth shut and be thought a fool than to open it and remove all doubt!"
