Shooting victim faces charges

A man was shot after he jumped a fence and ended up in a Cabot homeowners yard. The homeowner claims the man tried to steal his utility trailer. It's an accusation, Terry Linz denies.

"My truck breaks down on the side of the interstate, I'm cutting through a guys yard, the homeowner comes out and confronts me," said Terry Linz.

But on January 9th, at 9pm, the homeowner Robert Moyers did more than just confront Terry Linz he shot him in his side. Now, Linz is on trial in Lonoke Circuit Court charged with attempted theft of property.

Of course there are two sides to this story. Terry Linz says his truck broke down and he hopped the fence to get to his ex wife who lives nearby and call a tow truck . But the homeowner doesn't see it that way. And as soon as he saw a man in his yard he said he was shooting.

Homeowner, Robert Moyers declined an interview. He's charged with second degree battery. His attorney says his client was just defending himself and his property.  FOX16 was also told Moyers was on edge because a thief went after his property earlier in the week.

Now, a jury will have to decide who is at fault, the homeowner or the trespasser.  The homeowner, Robert Moyers pre-trial hearing is scheduled for May 26.

should be aloud to shoot anyone stealing yourstuff..

Number 1. If the guy needed to cut through a back yard, he should have knocked on the door and asked permission. As a homeowner myself, I support the right to keep people off your property. That is what fences are for. Number 2. Legally, you cannot shoot someone from simply being on your property. They have to posses the intent to do you harm, capability to do you harm, and opportunity to do you harm. I would rule in favor of the homeowner. Otherwise what kind of message are we sending out? That it is ok to harm peoples property? Fences are not build to support the weight of a grown man. Fence damage is likely. We must support our right as homeowners.
