Suspect in stabbing found mentally unfit

FORT SMITH, Ark. (AP) — A Fort Smith man accused of stabbing his pregnant wife has been found mentally unfit to stand trial.

Sebastian County Circuit Court Judge James Cox signed an order Tuesday committing 34-year-old James Herring to the custody of the Department of Human Services for detention and treatment.

Herring faces two counts of capital murder for the May deaths of 32-year-old Celestia Marie Duffin, and his unborn child, who was delivered by emergency C-section after the stabbing but did not survive.

According to the Southwest Times Record, a psychologist's report found that Herring suffered from a mental disease that prevented him from understanding the legal proceedings against him.

The judge also told prosecutors to file a written report within 10 months that assesses whether Herring could become mentally fit with treatment.

Now that was a good movie! You are correct itsjustme; smart enough, you don't need 10 years to get back at people that screwed you. I like the wanted posters idea also. I'm too old to go bounty hunting; but I'm sure there are many out there that are willing and able if perps were wanted dead or alive! Reminds me of my days in southern AZ, and the history there. Justice was swift in the old west! Get a rope! None of this BS sitting on death row for 20, 30 years.

@Chris2emily I agree with what you said, he had enough sense to get married something like 2 weeks before he kill her and the child. That is also a legal move, but now he doesn't understand BULL

He was stable enough to get marry and make a baby if he was that off the rocker he shouldn't have ever been marry because he shouldn't be able to understand what it meant

itsjustme & Yank I agree w/ you both the DA's are making publicy safety near none existent now days. Also all the plea deals and things like this reminds you a lot of that movie "Law Abiding Citizen" when the guy was basically so angry w/ the justice system that he devised a 10 year plan to get back at the justice system.

Yank, I'll tell ya where it will end. It will end when the public finally gets its fill of this crap and starts taking the law into their owns hands. Its getting to that point. People are tired of criminals getting away with murder (no pun intended) and they are tired of the ever failing justice system. The time will come when there will be public bounties placed on criminals. Remember the old wanted posters that said "Wanted, Dead or Alive"?
