Teacher's union takes PCSSD to court

Unionized teachers in Pulaski County are taking the district to court.  It's the latest move in a back and forth struggle between classroom teachers and the school board.  Teachers say it's pretty simple. The district isn't holding up their end of the agreement with teachers.  So they're taking the dispute out of the classroom and into the courtroom.

Teachers Union Leadership hope the three page lawsuit are the last word.  They are suing PCSSD for breach of contract, a direct response to a vote to no longer recognize unions last week.

"It was an irrational decision on the board's part and sometimes things like this happen because of it," PACT president Marty Nix said.

The suit says failing to recognize the union violates the teachers contract. As does the decision to raise all employees salaries.  "It's disappointing its going to court but the board has had to make some tough decisions," PCSSD interim superintendent Rob McGill said.

A lot of decisions are coming quickly, including the hiring of 20 substitutes late last week following a one day work stoppage by half the districts teachers.

"We have some issues to deal with but we are not in crisis," McGill says. "We are teaching children everyday."  Superintendent Rob McGill says he stands behind the school board's decisions even as the union takes legal action.

"They agreed this is the contract we're working under, but they're not abiding by it," Nix responded.

What the contract means now is up for the courts to decide.  The union filed a lawsuit Tuesday at 4:30 accusing the district of breach of contract when it voted to not recognize it anymore.

Will the PCSSD School Board members (Mr. Clark, Mr. Wood, Mr. Gilliland, & Ms. Tatum) resign if they district loses the lawsuit because of all the consternation and waste of money they cost the district?

memyselfi, If you are such a bright light why don't you take the test and teach. Maybe you don't because the children would play you like a banjo, or maybe because you don't want to work the long hours/evenings/weekends/summers, maybe its because your selfish, maybe because you don't want to spend countless $ to buy supplies/help children, maybe because the kids might kick your butt, maybe its because as the head of house hold you can't raise a family on meagar teacher pay? Put up or shut-up!

I'm just glad I don't have PACT's nerve in my tooth! You walk off the job causing the ditrict to panic and prepare for a strike then complain to the court over things your actions caused! I think anyone regardless of college that can pass a teachers certification exam should be let in to teach. Then maybe we wouldn't have a bunch of old bags complaining about how they hate their jobs. You chose the wrong career path and now you don't like it. STOP holding the students hostage to your poor work ethics. You are paid with public funds it's never going to be what you want it to be. Take your resumes somewhere that will give you what you want. Out with the old in with the new!

PACT continues to be a thorn in the side of our students best interests. It is amazing at the treatment that I have witnessed the PACT teachers since they have been back on the job in my building. I am a non-pact member and proud of it as I didn't get into education to become rich, it is because I can make a difference in children's lives. Our pact rep stirs the pot constantly and now little pods of teachers are meeting to discuss PACT during their planning time instead of planning like they should be. I had a new teacher tell me that she wants out of PACT because of how she has been treated and was told that wasn't possible at least until summer! We are supposed to be professionals that care for our students and to develop future leaders, instead we have chaos and controversy. I hope that the judge sees the damage that PACT is doing to our students and backs the board for its decision.

The Board is throwing money around that they always claimed they didn't have. Makes you wonder what else they've lied about all this time. It's about time a law suit was pursued. It will be the only way to get to these folks that refuse to do the right thing. PACT POWER!

it is most unfortunate that the kids have been forgotten but beinging a former worker that worked at a place that taught physically and mentally handicapped citizens to perform everyday tasks we also had to make daily plans, daily grades, bus duty, lunch duty, and bathroom duty... we did just fine without an union.. i do believe it is called TEAM work...even though the board no longer regonizes the union the teachers still got the raise asked for...for the sake of the kids please become a TEAM and work together and stop depending on other ppl and organztions(union)to accomplish what you need or want...the union worked well in the past but today the union is one of the many reasons companies are taking jobs from American ppl and taking the jobs overseas or causing ppl who have worked all their lives at a job to lose everything because the union has made demands on the company that the buisness can not fulfill so the worker gets laid off with no income or insurence...teachers are suppose to be educated intellagent ppl....get a back bone...pull together...stop complaining about the little things...work as a TEAM to accomplish what you seek and need for the children

It is unfortunate that a lawsuit had to be filed but parents, students & the public at large much less PACT & PASS has gotten no where with the school board since their vote on Dec. 8th. If anything the behavior of the board at each "emergency" meeting has escalated an already volatile situation. It would be so much simpler to make decisions made on sound judgement and fiscal responsibility. Had the board shown some restraint or real leadership all of this could have been avoided. I support the lawsuit of PACT and hope for a speedy decision so that all of this can become a distant memory, and let teachers get back to doing what they do, teaching children. Good luck PACT!
