UPDATE: Parole denied for man charged with sexual assault

Brian Floss was denied parole.  Floss has served six years in prison for the sexual assault of the 8-year-old girl.  It was the third parole hearing for him since he has been in prison. 
The mother of a rape victim is fighting to keep her daughter's attacker behind bars. The man has served six years in prison for the sexual assault of the 8-year-old girl. The mother testified at Wednesday’s parole hearing. We are not using her last name to protect her daughter's identity.

"I honestly think he is a serial pedophile," said Tammy, who is doing everything in her power to keep Brian Floss behind bars. In 2003, Floss made a deal with prosecutors and pleaded guilty to second degree sexual assault. Tammy says Floss raped her 8-year-old daughter in her Fordyce Elementary School classroom.

“He was her teacher. She totally trusted him," said Tammy.  She says it happened several times to her daughter and a handful of other young girls "in the classroom, day in and day out."

This is the third parole hearing for Floss. Tammy says she will be here every year fighting to keep him in prison. "She's my life. I'll fight tooth and nail for her," said Tammy.

Floss has served six of his 10 year sentence.

"My daughter is so scared, she has nightmares," said Tammy.

Tammy's daughter is now 16 years old, and wrote the parole board this letter:

"Thoughts of me running into him, of him tracking me down, molesting or hurting other kids the way he did me. These are thoughts I don't want in my mind."

Attorney Richard Watts represents the victims and says Floss is a danger to society. When asked if he thought Floss would attack again, Watts replied, "I believe he will. I wouldn't want it on my conscious to let him out."

"How could you have done this to my daughter? I can't understand how a grown man could hurt a child in that way," said Tammy.

Tammy's daughter has received extensive counseling but Tammy says she still has nightmares.

The Arkansas Board of Parole will make a decision on whether or not Brian Floss will be paroled on February 3. FOX16 will continue to follow this story.

i would like to thank fox16 for their concern about this story and for being there with us, my attorney Richard Watts for all that he has done and continues to do for our family,and all the prayers from friends and my church family,and to each one of the parole board members for their decision to keep Brian Floss behind bars and away from children. I am so glad his parole was denied. I am originally from his parents' hometown and know the family personally. I do feel he is a threat to children. The longer he is there the better. I do not think pedofiles can be rehabilitated. He never needs to get out.

The judical system has failed this young lady and her family. I cannot believe the prosecutor in this case plea bargained down to a menial 10 year sentence. This child predator should have received a minimum of life imprisonment without the possibility of parole. It has been documented numerous times that pedophiles like him are never rehabilitated and only released back into society to destroy another child's life. Any person with a minor daugher should be scared to death of this guy. I wonder who will be watching him during his "so called supervised visitation" with his seven year old daughter? Maybe the same parents who conveniently covered up and swept under the rug his past molestation of two cousins in Ohio. Hopefully, the Arkansas Board of Parole will do their jobs and at least keep this sick animal behind bars for the maximum of his paltry 10 year sentence. mark8694

I can't belive how little time this creep got for raping a child. where is the justice and why are they giving these creeps so little time for hurting babies this is unreal and unjust. he should do day dor day and then some

I hope they keep him behind bars. 6 years is not enough. I sent (and the law) my ex-husband (their stepfather) for life (2 life) and I am going to make sure he will never get out to hurt another child like he did to my 2 daughters (8 & 10 at that time)17 years ago. It is painful because you never recover from that, the pain is there, it will never go away no matter what. I know her pain (mother & child) because it is going to be there for the rest of our lives. Keep him behind bars, he belongs there. People like him don't deserve another opportunity. Don't let him out & I wish the law would make some changes about these kinds of crimes and make it harder to punish those sick people....I know your pain, keep fighting for your daughter's rights & other children.....Alma

the only problem i have is...someone didn't "pop a cap". he is a sick individual, as a grandparent, if i found out one of my babies was being molested, you wouldn't make it too court!!!!!!

Tracy Samples I am the aunt of Brian Floss's 2 children. Jacob is 10 and Jessica is 7. I know first hand what they have gone through since he has been in prison. Brian also molested 2 of his cousins in Ohio ages 4 and six some 15-20 years ago before he and his family moved to Hampton, AR. He has ruined his cousins lives and they were going to come to testify against him at his trial Feb. 2003. This is why he took the plea bargain, he knew he would be found guilty and serve a sentence far greater than 10 years. From what I have learned about convicted child molesters they never stop, they are never cured. They usually have a preferred age and sex this is why I am pleading that he not be let out. I fear for my neice's safety, she is only 7 and is in the "age" that these other children were that he molested. I think if a parent doesn't know about what has happened then they should be innocent in the situaion, however; in this case his parents knew he molested his cousins and yet paid for him to go to school to be a teacher, to be around innocent children. They allowed swimming parties at their house (unsupervised) when he taught special education at Hampton. The rapes of his cousins in Ohio were in his parents home, they moved him and the family to Hampton and "swept this incident" under the rug so to speak. This did not prevent his 2 cousins from suffering throughout their lives because of this horrible crime. I say his parents are as much to blame as him for what he has done. His Dad is a Dr. and his whole family is acting like he didn't even do anything. He took a plea bargain admitting his guilt. He has done this before and will do it again if released. I am pleading with you not to let him out to fall prey on our innocent children. Tracy Samples

PAROLE? i don't think so! i'm there with you tammy, maybe only in spirit..but i'm there. as are all the parents and grandparents in this country. i can't express the sorrow i feel for the children who suffered this outrage at the hands of this scumbag. not only should this P.O.S. not be granted parole, he should never see the light of day. this mother and young girls fears are justified. look on the most wanted list, how many are "failure to register", how many warrants are issued for "failure to register" or "absconding"? so being told the trash must register is NOT a problem for them. they just don't do it and move on to the next place. i'm not blaming the local police departments, but the higher ups for NOT allowing the FREE and EASY ACCESS to pictures and names of convicted rapers. it is said it is an infringement of their rights! who gives a crap what molesters and rapists lose...they made that choice when they TOOK what they took from the children and adults they hurt. what about THEIR rights. we as a society have the right to be free from danger! and these criminals ARE a danger to the public. it is truly a sad day in this country when the powers that be worry more about protecting the rights of a pedophile than the rights of a child. good luck in your fight tammy, you and your family are in my prayers. the only advice i can offer you at this time is to NOT let him control you...YOU control YOU!

How is it that this man only got sentenced to 10 years to begin with? Rape of a child should automatically be a life sentence, and if you are in a position of authority, this man was a teacher, the death penalty is warranted and should be immediately carried out. My heart goes out to the victims and their families. I hope that wrath and vengeance are served upon him when he faces God.
