TEXARKANA, Ark. (AP) — The family of a Fouke, Ark., teenager who died after being hit by a tractor-trailer has sued the driver of the truck and his employer.

According to a story in Sunday's Texarkana Gazette, the wrongful death lawsuit alleges the driver of the semi, Marc Simard, was talking on a cellular phone shortly before the Aug. 19 accident along Interstate 30 near Hooks, Texas.

State troopers say 16-year-old Tommie Roden was riding in a car that was involved an earlier accident with a pickup truck, and she may have been walking back to the vehicle when she was killed.

The lawsuit, filed in Texas, seeks compensation for past and future mental anguish for the plaintiffs, including Roden's mother, Sandra Ward.

A message left at Drive Logistics' offices wasn't immediately returned Sunday.
