5 Teachers sue PCSSD

A group of five Pulaski County Special School District teachers is suing the district.

In this class action lawsuit, the teachers claim the board's decision to dissolve the union by month's end is illegal.

"The deadline is drawing near, and I think some folks are feeling a little bit desperate," says PCSSD Board President Tim Clark.

With with just two days of school left, teachers are challenging the school board's decision to replace their union with a Personnel Policies Committee, or PPC, July first.

"I'm not surprised. I mean, this was pretty expected," says Clark.

A hearing later this month would have been the next step in the legal battle between the district and the unions, but, in the 98 page complaint filed Friday in circuit court, the teachers claim the district can't scrap the union because "it is not reasonable to expect teachers to form a Personnel Policies Committee in the last month of school" and review those policies during summer break.

PACT's attorney told FOX16's Kelly Dudzik Saturday, "unfortunately, this board does not want to afford the teachers their opportunity for input."

"The timing is a little off, but I think that we have more than substantially abided by the law," added Clark.

State law says PPCs have form in the first quarter.

Teachers rallied last month, saying they want their contract to continue even though the board decided to stop recognizing it twice.

Then, under the Teacher Fair Dismissal Act, the district held a hearing for union members.

The majority of the board, which usually votes 4-3, is confident the judge will rule in its favor to replace the union with the PPC.

"We're getting extremely tired of these kinds of events occuring, especially at the end of the school period especially when all focus should be place on the children," says Clark.

The teachers' attorney won't let them speak publicly about the case.

The last day of school for PCSSD students is Tuesday.

As a PCSSD teacher and member of PACT, my primary desire is to teach youngsters the content of my subject matter. I want them to become well informed, productive and happy citizens.Continuing to have PACT as the recognized negotiating agent for teachers in this district will help contribute to the achievement of that goal. However, I could live with a decision to switch to a Personnel Policy Committee just as I can live with a president I didn't vote for - if the switch is done properly! So far the board has done all it can to ram the change through, in violation of the established process. America is a land under rule of law, not the whims of politicians. We have a court system to enforce the law when elected officials attempt to subvert it. Thatis why this suit was filed, and I support it. Nobody is above the law from president to dogcatcher. We need the board to "substantially" uphold the law - we need them to uphold it completely. If they won't do it voluntarily, hopefully the court will assist them to do so.

It seems to me that everyone has lost sight as to the purpose of schools. Schools are supposed to educate our children. However, political "stuff" keeps getting in the way. Teachers are not treated as professionals either and that helps fuel these problems. In many school districts, there are assistant principals, superintendents, deans of students, and that seems redundant to me when teachers can't even get aides for their classes, but there are plenty of administrative positions available...NO SCHOOL SHOULD HAVE ASSISTANT PRINCIPALS AND SUPERINTENDENTS.........PERIOD...That would maybe allow teachers to get a decent raise once in a while...I love teaching, but the reality is that I still have to pay house payments, utiity bills, etc...I would not want a child of mine in this troubled district that is always on the news...

Without the union the school district can impose their will. Teachers in other districts are afraid to raise the BS flag because of fear of reprisal from administrators. The union helps to keep the playing field level.

I have kids in PCSSD and am active as a parent--I can tell you that it's come down to an 'us vs them' bettle between the board/administrators and the teachers union--and they have BOTH lost sight on the kids. I think the straw that broke the camel's back for me was when I learned my kid's teachers wouldn't attend open house at the start of the year because the union stipluates they should be paid $50 to attend. I wish the school's had all the money in the world to pay the teachers what they are worth (cause they do need to be paid more)--but emotionally--to think they would miss maybe the only opportunity to meet a kid's parent and make sure they were able to explain their class expectations--for $50--told me how much they valued educating my kid. I wish the state would just take over and get rid of the Board and the teacher's union.

The teachers and the union are just wasting the tax payers money. The judge said the board can do this if they follow certain rules. The only rule they didn't follow to the letter is the one about when the PPC should be formed. Worse case is the union would have to be recognized until next summer so the board can form the PPC during the first part of the year. As for the union itself, from what the news said last month, PACT has only been in charge for the last 20 years. Is it just me, or is it just the last 20 years that schools have been going downhill? Only a couple of districts still use unions, and they seem to be able to hire teachers just fine. If PCSSD doesn't have a union, they will still be able to hire teachers. As for the teachers threatening to quit if they don't have a union, I say go f or it. If the union is more important than teaching our kids, then we probably don't want them in the classroom anyway.

I have never had a child in Pulaski Co schools but I have paid my taxes for 25 years and they have happily spent the money. I think the courts should get involved. The board has mishandled money and the running of the district. What would happen if every teacher quit and they couldn't hire any teacher for the lack of Union protection. Without the Union, the board can misuse and abuse their power and the teachers and students will suffer. All we have to do is look at the boards track record.

Judge Fox ruled against PCSSD twice and nothings come of it. Either Judge Fox does not enforce his rulings or there is no need for the judicial system. What good will suing do?

Public school integration is the reason why the educational system has ended up in the present day gutter. If the State and federal government had done the right thing by minorites when school were suppose to be separate but equal the educational system probably would have been more advanced by now. But we all know it was the practice of state with the assistance of the federal government to keep all minority schools extremely poor, underfunded and behind. The law of reaping what you sow is very true. America has a big debt to pay which will come at a high price!!

I have heard so many negative things about the PCSSD board. It sounds like the members should be replaced by people that care about the children and teachers. Right now it is a mess.Alot of it is control and racial differences. I am afraid that things are going to get worse with the recent changes.
