ACLU challenges law banning unmarried couples from adopting

LITTLE ROCK, Ark. (AP) - Three teenagers living in state-run group homes were allowed by a judge Tuesday to join a lawsuit challenging Arkansas' law that prevents unmarried couples from fostering or adopting children, a ban they say limits their ability to find a family.

Pulaski County Circuit Judge Chris Piazza ruled that the teens - ages 15, 16 and 17, but identified only by their initials - can be plaintiffs in a suit filed by the American Civil Liberties Union of Arkansas, which believes the voter-approved ban is unconstitutional.

State attorneys opposed the motion, noting that it came two months before the case was set to go to trial and will limit their time for depositions and discovery. But the judge allowed the new plaintiffs and declined to delay the May 10 trial, which is expected to last two weeks.

The ACLU sued the state in December 2008 on behalf of a group of families seeking to overturn the ban. Voters approved the measure in 2008, two years after the Arkansas Supreme Court overturned a policy by state child welfare officials that blocked gays from being foster parents.

The law bars unmarried couples who live together from adopting or fostering children. It effectively bans gays and lesbians from adopting or fostering children because Arkansas has a constitutional amendment outlawing gay marriage.

The teens, which include a set of siblings, are all in state homes because their mothers were addicted to methamphetamine. The suit claims that the law "makes it less likely that (the teens) will be fostered or adopted because it unnecessarily restricts the pool of qualified foster and adoptive families."

Assistant Attorney General Colin Jorgensen asked Piazza to not allow the teens to become plaintiffs so close to trial, noting that the ACLU has had more than a year to prepare its case. More than a dozen plaintiffs are part of the suit.

"The plaintiffs should not be permitted to buy time in order to salvage their own failed complaint," he argued.

The lawsuit challenging the law has been amended four times to adjust the list of plaintiffs, and Piazza questioned why the group took so long to find children affected by the policy.

"Why in the world does it take us over a year to put that in the complaint?" Piazza asked attorney Stacey  Friedman, who represents opponents to the ban.

She responded: "We couldn't go and stand in front of a state home and say 'Come join our case."'

I feel bad for those who don't stand for equality and do have children. Those poor kids will grow up being huge dicks to people and be the first ones to get their asses kicked. Straight people are no better than gay people and the holier than though attitude that some people below me have makes me sick. Once people realize that they are being selfish and LYING to our country by promising full rights to all, then the world will be a better place. One day when your sister, brother, best friend, cousin, or whoever tell you that they are gay, maybe then you'll find out how to accept people. I dont choose whether or not you have the right to marry and you shouldnt have that right against me.

It is obvious that many people in this country are so delusional about what being gay is and isnt. For example quiet4us says it is a disease that is curable by asking for god's forgiveness. Are you kidding me? There is no way I can make a logical argument to such a rediculously ignorant statement. Sparrowhawk says homosexuality is another form of lust and let me tell you that after being with someone for over 5 years, regardless of gender, there is very little lust left but there is mutual respect and love for each other. Together we raise the most wonderful child who is a very successful and happy kid. When is this country going to wake up and realize that all this hate is what is contagious to our children??? And I just cant understand what difference it makes to you whether or not I am married to a man or a woman? Seriously in your everyday life what impact does it have on you that I would have a wife?? By marrying my partner I do not lessen or cheapen the meaning/value of your marriage nor do I take away from or harm your lifestyle in any way, shape or form. You however, have hindered my rights as a tax paying, law abiding citizen of this country in that I will not have the same benefits, rights, and responsibilities as a hetrosexual married individual. Did ya ever stop and think that if you would just let us get married we would have no reason to march up and down the street and would probably fade into society? If you dont like us on the news and in your face all the time then stop discriminating and treat us as equal human beings. My heart breaks for these children that dont know what it is like to go on family campouts and fishing trips and they dont know what it is like to open presents on Christmas morning with their family all around them. So for those posting such hateful comments perhaps you would like to tell us just how many foster or adopted children you have in your homes??

Act 1 is a mean spirited law meant to further exclude the gay population from full equality by playing on the fears of straight people. The fact of the matter is that the overwhelming majority of the kids in foster care come from straight parented families. Two summers ago 4 children died while in the so-called perfect homes while in foster care. thats ame summer 14-15 children were removed from their "perfect" foster homes for abuse and neglect. Every year 200+ young people age out of foster care without having ever had a family to call their own and a stable home to grow up in. Are we so mean spirited that we'd really rather see these kids go without homes and enter the world with no family support as they attempt to navigate life? Families come in all sorts of compositions and it is the love, respect and care that we provide one another in those families that ultimately counts above and beyond marriage and sexual orientation. According to the 2000 Census there are 250,000 children being raised by same sex couples. This number is thought to be much lower due to the fear many gay people have in reporting to the Census. There remains no credible evidence that children in same sex parented households do worse than homes with married parents. All research to date shows that these children develop on a comparable level than their peers. I've raised my granddaughter for most of her life due to her mother's chronic illness. She is about to graduate from High School and she will then be going on to City Year to serve her community for a year. It is about the love and care and the quality of the parenting in a home. Not marriage staus or sexual orientation. Each potential home should be thouroughly vetted ebfore placing a child. Those who abuse or neglect the children in their care should be held accountable. And NO child should go wanting for a good, safe and loving home becasue of prejudice and homophobia! These kids need and want homes!

Here's an interesting insight: If approximately 50% of marriages do not last, adoption would be limited to the 50% that remain married. Let's just do a half-arsed job on everything!

I'm happy the ACLU is challenging this mean-spirited law. I'm a parent, and my marital status should have nothing to do with my adoption of children. Look guys, being a bigot works when you have the momentum. You bloodied the eye of your gay neighbor in the election of 2008. But you're losing steam. Outright discrimination is always going to die a slow, ugly death in this country. Other countries seem not to be such slow learners. If you are against gay marriage, don't have one, don't invite gay people over. Ignore us and you'll barely notice us. But stop micromanaging our lives. Are you aware that the ACLU represents right-wing Christians and the KKK? They represent all civil rights. Not just the ones you are comfortable with.

@BigEarn The job of the courts is to protect the minority (though your 3% statistic is grossly inaccurate) from majority rule. If that weren't the case we'd never have advances in basic human rights. @sparrow Everything from your marriage argument (allow same-sex marriage and we won't be "showing a level of non-commitment" any longer) to your "parents have always meant a mother and father" statement are ignorant and saddening and your "fact" are also highly inaccurate. @michaellrar Have you ever heard of CIVIL RIGHTS?

I am in agreement with the other two comments. Unmaried couples show a level of non-commitment by not being married. Why don't they marry? They say the peice of paper means nothing. If it doesn't what's their problem with getting it? It costs very little and it stands for commitment. Isn't having a child a commitment too??? Statistics show gays have an even higher rate of break-ups than marriages. Parents have always meant a mother and father. Homosexuality is just another form of lust. When they can't control their sexual lusts makes you wonder what other lusts of that extreme they can't control. Society as a whole has enough problems in the lust area. Why add another. How much are they really thinking about the child when they don't consider how the rest of society feels about this issue?

I agree with you 100%. The ACLU is the most left organization there is. Arkansas Voters passed ACT ONE in 2008. Why does the ACLU think they can change it. I hope the government doesn't cater to them. Gays only make up 3% of USA's population. If the other 97 percent would stand up!
