FORT SMITH, Ark. (AP) — An Arkansas man will serve 10 years in prison in Oklahoma for a guilty plea to a robbery in which a 1-year-old baby was shot to death.
Fort Smith television station KFSM reports (http://bit.ly/qr3l6A ) that Michael Clemente reached an agreement with prosecutors Tuesday to drop a first-degree murder charge.
The baby's mother and two men still face murder charges for the 2010 slaying of Elaine Keene.
Prosecutors say the mother, Heather Jones, is charged with first-degree murder, as is Aaron Bowen. The robbery victim, Devin Jeremiah, is charged with second-degree murder. Jeremiah allegedly fired at a car carrying the baby, Jones, Bowen and Clemente, after the robbery and a bullet killed baby Elaine, who was in the car.
The remaining defendants have pleaded not guilty.
