De La Rosa rape trial

4 witnesses took the stand in the first day of the trial of a waiter accused of raping a 7-year-old girl in a restaurant bathroom.
LITTLE ROCK, AR - Four witnesses took the stand in the first day of the trial of a waiter accused of raping a 7-year-old girl in a restaurant bathroom.

Marco Antonio De La Rosa is accused of assaulting the girl last February in the bathroom of the Casa Manana restaurant on Cantrell Road in Little Rock.

Police say De La Rosa lured a 7-year-old girl away from her family into a bathroom and put his hand down her pants.

The girl's mother, father, and two other adults with them the night of the assault took the stand Wednesday describing in detail how the events of that night occurred.

The mother told the jury they were having dinner with a group of people when her daughter left the table. When the girl came back, she was crying, and told her mother a man had touched her inappropriately.

The mother and father both testified they alerted the restaurant manager and began looking for the man. The parents testified De La Rosa came out of the restaurant bathroom and the girl identified him as her attacker. After police arrived at the restaurant, the girl went to Arkansas Children's Hospital to be examined.

The defense questioned the parents about how long it took to call police, and raised the possibility that the attacker left the restaurant before officers got there.

The prosecution expects to call 8 more witnesses to the stand including the victim. The lawyers seem to think they'll have all the witness testimony complete Thursday.
