LITTLE ROCK, AR - The Arkansas Democratic Party filed suit in Pulaski County circuit court Tuesday against Fred Smith, Secretary of State Mark Martin along with election commissions in Cross and Crittenden County to try and remove Smith from the November ballot.
In a 12-page filing, the Democratic Party says former Representative Fred Smith is ineligible to serve because he was a convicted felon at the time he filed for office on March 1.
The pleading claims, "Smith did not present a certificate of expunction to the Secretary of State as required despite the Secretary of State having knowledge of Smith's conviction."
Smith is running for House District 50, currently occupied by Hudson Hallum (D), who has also filed from re-election.
