Dismissal sought of petition to remove sheriff

MARSHALL, Ark. (AP) — The attorney for Searcy County Sheriff Kenny Cassell is asking for dismissal of a petition seeking removal of the sheriff.

Attorney Joe Don Winningham filed the motion Friday in Searcy County Circuit Court in Marshall.

Prosecutor Cody Hiland has filed papers to remove Cassell from office because of a misdemeanor conviction in 1979 for knowingly possessing stolen Cornish hens.

Cassell acknowledged the conviction while running for sheriff and bought an ad to explain the case.

Hiland says the state Constitution prohibits anyone convicted of an "infamous" crime from holding office.

Winningham's motion says Cassell's misdemeanor conviction is not an infamous crime.

He stole a chicken! We have plenty of stray dogs around here that do that. People still want to protect them!

it's so long ago who really gives a crap. it the guy is doing a good job don't bother with it.

he is not one of he "good old boys". They cant stand anyone honest in office because then they cant get away with whatever it is they choose to. This petition should be thrown out as it was all disclosed before the election. After it is cleared up he should dig into their past and find out what disqualifies them for office

He was very open about this from the get go. If it was going to be a problem, he should have never been allowed to run for public office. Obviously the sheriff has made someone mad and they are spear heading this effort. Like I said, this should not be a problem now if it wasnt when he ran.
