Monday, the attorney for a former Bryant band teacher facing a sexual assault charge involving a student says his client is innocent and evidence will prove it.
Documents FOX16 obtained Monday using the Freedom of Information Act reveal Bryant High School's former band teacher, James Chad Green, resigned from his position with the district on October 24, 2012.
Green is charged with first degree sexual assault following a year-long investigation into allegations involving Green and a student.
Monday, Green's attorney said the evidence against his client does not add up.
"We actually have come into contact with some information, a Facebook page, where the alleged victim in this case actually said something about getting his payback," says attorney Bill James.
In his resignation letter to Bryant's superintendent, Green says: "Although this decision was not an easy one and involved many hours of thoughtful consideration, I will always maintain my original position of not having engaged in any wrongdoing."
Green's attorney says the accuser is a young man dealing with serious issues.
"He was put out of school. I think the evidence is going to show because of drugs. That actually Chad Green tried to help him and was his band instructor and tried to help him for a while and eventually told him that he needed to leave band because of the problems he was having in his life and ultimately lead to this allegation," says James.
Reached by phone on Monday, Bryant's assistant superintendent told FOX16 that Green has not led the band since January when the district put him on paid leave. After that, the district suspended Green with pay followed by another suspension without pay.
But, the administrator we spoke with refused to give dates or explain the district's decision-making process.
Green's attorney has a message for parents who might be concerned.
"I don't think anyone had anything to worry about from Mr. Green in the first place, and I certainly don't know of anything going on in the Bryant School District at this point that would cause any parents to have any concerns," says James.
In his resignation letter, Green says he has accepted a position with another company and wishes nothing but success for the Bryant band program.
Green is scheduled to appear in court on Monday.
