A $1 million bond is keeping the man accused of killing Arkansas Tech student Nona Dirksmeyer in jail right now.  A Pope County judge held a bond hearing for Gary Dunn, 28, on a capital murder charge this morning.  Dunn didn't say much in court but his family did.

With cameras rolling and his parents watching Gary Dunn made his first court appearance, accused in the 2005 murder of Nona Dirksmeyer.

Dirksmeyer’s nude body was found beaten and stabbed to death in her apartment on December 15th, 2005.  Her boyfriend, Kevin Jones was put on trial for her murder in July 2007 and found not guilty.  Last Friday, police arrested Dunn without incident in Center Ridge for Dirksmeyer's killing.

"I know in my heart my son didn't do this and I stand behind him 100%," his mother Martha Dunn says.

The hearing was short, just to determine whether Dunn should be let out of jail on bond.

"Whether or not you are innocent or guilty will be decided once you get to circuit court," Pope County District Judge Don Bourne said.  "Anything else you want to say or add before I set your bond Mr. Dunn?"

Dunn said nothing.  The judge set his bond at $1,000,000.

Special Prosecutor Jack McQuary is believed to have DNA evidence linking Dunn to the crime scene where Dirksmeyer was killed.  An arrest affidavit says a condom wrapper found near Dirksmeyer’s body had DNA from both her and Dunn.  And it has been revealed nearly three years after the killing that Dunn lived in the same apartment complex as Dirksmeyer at the time of the killing.

None of those facts that seem to implicate his stepson change the feelings of Preston Chenoweth.

"It doesn't worry me because in my opinion if they had it they would have used it before,” Chenoweth says.

Chenoweth says his stepson is a quiet man and a good worker who assisted him on construction projects around the area.  He says the last time he spoke to him was a few days before his arrest.  Chenoweth says Dunn was optomistic about finding more consistent work, but explained few employers would hire him with a felony on his record.


Dunn has that felony conviction from a 2003 second degree battery assault on a female jogger at a Russellville park.  He was sentenced to six years in prison and served two.  He was on parole at the time Dirksmeyer was killed in 2005.

"I've never in the 53 years that I've been alive seen my son lay a hand on any woman," Dunn says.

She says now Russellville Police and the special prosecutor in the case are victimizing another family in their search for Nona's killer.

"I feel sorry for Kevin (Jones) for what he had to go through and I feel sorry for Nona's parents for what they are still going through,” Dunn says.  “They need closure, they need answers.  But my son didn't do this."

And his family says if it goes to trial they want it moved out of Pope County.  The next court appearance for Gary Dunn is September 22nd at 9am.  His family says most likely a public defender will handle his case unless a defense attorney wants to take it pro bono.

I have serious doubts that a viable sample of dna was on the condom wrapper and that it wasn't processed for 3 years. Even if Dunn did have sex with Nona, that proves nothing. She apparently was having sex with quite a few people. I personally think Jones did it, but under the circumstances, I don't think he should be punished for it. Assuming he did it, I think he hit her with the lamp but did not intend to kill her. I think Nora was playing him for a fool and he felt so betrayed that he exploded. There is no way they can convict Dunn. What a waste of taxpayer money. I find it difficult to feel sorry for a two-timing tramp. The step-father of Nora is a creep also.

Yeah the DNA on this guy is a little suspicious.Like why did it take so long? I know they said in the beginning it either had to be DNA or fingerprints, but they managed to get both.Had Kevin Jones been found guilty he would still be sitting in jail.Is that same cop going to scream into his face saying you did it!! We know you did!!!Just like they did to Kevin Jones. If I was his lawyer I would use the tape of the cop yelling and him on the TV show 48 hour mystery emphatically stating he knew Kevin Jones was the murderer.Now you KNOW it's Gary Dunn! Maybe it's someone on this board, that is the faith I would have with the Polk County cops.It was their own words that caused the not guilty findings.At least they were honest in their testimony. The blood found on the light bulb was "tacky" which meant "still wet". So Kevin Jones was telling the truth.Plus according to their friends he did not have a bad temper. As far as him punching out a chair in the Police Station, he was deliberately set up. Of course he was angry, his beloved girlfriend was murdered and they put him in a room for hours just to watch him.His parents should have gotten him a lawyer right away, the would not have been able to do what they did.Just because you are innocent and the police are acting like your friends GET A LAWYER. I am a Policemans daughter and I do not trust cops today, if there is no evidence they will invent some. And as the saying goes a good Prosecutor could get a ham sandwich indicted.

We wouldn't even be talking about this if justice had been served the first time around for Gary Dunn. He should still be in jail for the assault on the jogger. He he had completed his service he would still be there, Nona would be alive probably planning her wedding to Kevin.

Let us also remember that if Dunn did kill her then the justice system failed twice. The first time when they let him out after only serving 2 years when he should have served six. If he had served his time, Nona would still be alive and none of this would have happened

I don't know Dunn and I don't know whether or not he's guilty and I'm not assuming he's guilty just because he's been charged (as I doubt his family and best friends know for sure he DIDN'T do it either, their obviously being biased). However, guilty or innocent of THIS crime, I think it's appalling that a man convicted of a violent crime was released from prison after serving only ONE THIRD of his sentence. And perhaps his family and friends might consider that, had he still been serving time for the crime which I assume he DID commit, perhaps he would have been in prison at the time of Nona's murder, then there would have been no doubt of his innocence of THIS crime, would there? And if he IS guilty, then Nona would most likely still be alive today, wouldn't she? Either way, letting a violent offender out early has served no useful purpose, in my opinion.

I would like to comment on the Pope County Judicial System. I pray that the family of Nona will have closure & see justice served. I pray that a fair trial will be given. As for my family and I we have yet to see it. It will be 3yrs. this Nov. that I lost my brother in law (Quenton W. Riley). He died due to an altercation which took place in his car while he was driving. Pope County conducted an insufficient investigation. I feel that if it had been one of their family members, justice would have been pushed to the max. Instead we're left w/ memories and unanswered questions. It's 1 thing to lose a loved one, but when you have no answers to why someone took his life and no one admitting to it is another thing. My heart goes out to Nona's family. I have numerous documents including police, autopsy reports & interview statements with substantial evidence. However we're left with JUSTICE undone. There a numerous holes in their so-called reports. There were 3 passengers in the car. When the interview investigation was conducted only 2 of the passengers gave a statement. The other passenger let his uncle give his statement for him, by the way the uncle was not in the car or at the accident scene. Now what is really absurd is that in one of the statements the passenger simply says that the back seat passenger grabbed Quenton's neck while driving and would not let go. Oh and by the way this back seat passenger is the one who didn't give his own statement, the uncle did. I just don't understand why evidence is dismissed. On Quenton's death certificate it describes his death as "subject sustained multiple blunt force injuries "AFTER" altercation with suspect causing loss of vehicular control. I just want justice to be served. I pray that all passengers involved have made peace with God & themselves. I have forgivenes, but would like closure. I pray this for all the parties involved in Nona's case. Please pray for our family that we have the closure we deserve!!

This is Jessicas Uncle and i would just like to say something about the system in pope county. My brother Quenton Riley was killed in November 2005 and David Gibbons didn't even question the person who did it even though they knew who he was. He was choked him from behind causing him to wreck and beaten to death after hw wrecked. So I guess you have to be a beauty queen to get any justice served????

marelou13...Your a idiot. If you would listen, Pope County Officers and Arkansas State Police was not envolved in the first investigation when Mr. Jones was charged. Russellville Police performed the first one. It sounds like Pope County and ASP Officer's got the right guy. You need to think before you start typing....

Frist of all I hope that Gary Dunn will get a fair and unbias, no I pray to GOD that he get's a fair and unbias trial. Not like Kevin Jones, Gibson had a rush to judgment. Poor investiation, reckless, and a disgrace to your justice system. Please remember a man, woman is inocent until proven guilty.

I am also a supporter of Gary Dunn and I do not beleive he does this so to those who say it only took 3 years or all the other negative crap that is being said i would suggest you look at the facts of this case. One being the DNA!!!! I have read all the facts in this case so far. Including the DNA facts that are on the news and in the papers and so on and so on. NO WHERE does it say they found Garys DNA on anything but the condom wrapper and frankly kevins lawyer is the one who ran that. Leaves me a little skeptical as to whos DNA is really on it. KEvins attorney new they ruled out a felon already so why not pin it on him anyway. It was pretty easy for him to get his DNA to test it was it not?? Makes you wander about the DNA evidence they do have? Also it has been stated several times and let me post it again for you all.. "When asked why he didn’t submit the condom wrapper for DNA testing, Frost said he called the State Crime Lab and was told he could either test for fingerprints or DNA, but not both. Frost said he opted to test for fingerprints." Also the paper is saying Gary lied about his whereabouts but gary has never lied about his where abouts they police just think he did. You got to have proof not crap you read in the paper. Hell if you beleive everything in the news paper do you beleive everything in the enquirer? Aliens really do exist...Yeah prove that one.. See what I mean about news you read. Any way I support the DUN family and GARY for that matter and hell Im not in the same state but I know gary and the dunn family.. My prayers are with you all...
