Gould city council members say ordinances to be amended, not repealed

GOULD, AR - The Gould city motto is, "A City United For Change" but ordinances deemed unconstitutional by the Arkansas Municipal League are tearing the city apart.

"We've got people now that used to be close friends not speaking to each other. That's not right," said Gould City Council member Essie Cableton when asked about the ordinances.

"It's been a long week," said Gould Mayor Earnest Nash.

Bombarded with countless phone calls, Mayor Nash continues to fight against city ordinances - one stating people cannot discuss city business without council approval.

"This whole battle all boils down to our basic constitutional rights," said Mayor Nash.

Council Member Harry Hall says one ordinance should actually be written to ban groups from meeting in a city-owned community center because the city can't afford to pay the utilities for the building.

"Get your own place. Don't use the city," said Hall.

Right now, ordinances are written that ban people from discussing city business unless approved by the council.  Lawyers say it's a violation of the First Amendment.

"One of the ordinances was misprinted," said Hall. "We've got new council members so we are entitled to some mistakes."

 "If you don't know what you're doing, than you don't need to do it," said council member Cableton, who opposed passing the ordinances in the first place.

But there are still other ordinances that need answers.  For example, one is written to ban the mayor from meeting with people without council permission.

"The Mayor wants control over everyting and were just not going to let him have control," said Hall.

Council members say the ordinances will not be repealed, only ammended, meaning there's still a long way to go before these conflicts get resolved.

The next city council meeting is set for August 9th.  Although on the books, so far, the ordinances have not been enforced as written.

I would like to know why Mike Malliard, Pam Gibson, Ray Blankship, Brenda Karr, Howard Holthoff and others harassing Mayor Nash for stand up for his rights? And some needs to ask what part anlong with Mary Prewitt play in the actions of the city council?

Gould Council, how in the "H" are you going to tell people what they can or can not talk about in their own homes. I think your whole Coucil neeeds to be fired and new people hired. If you can't get your city together, this is where your headed. Mark my words.

Factfinder21-In response to your 11:33am comment: Correction: I was aiming to ask the question of: Do the city members/organizations pay dues and have they not been allowed the opportunity or willing to rent the building? Are there not other buildings in the city that are rented all of the time, some of the time, or at least available for rent? I am the same as you are, confused. Was the building donated to the city of Gould for the citizens or was it taken control of by the city of Gould? Was the "various organizations" utilizing a city building before they begin utilizing the "bank building"? Was the organizations informed by the building facilitator that the building was to be rented before they was allowed to occupy the building? Is there a renter's agreement/contract for the building? It is acknowledge and understood that the 4 city council members took office January 1, 2011. However, if deciding how to use the building and who should occupy it is of top priority, why did the 4 city council members not address it, vote on it (if applicable), and put the proper documentation and personnel in place within their first 90 days of office? Is occupying a building the city's main issue? Does the city not suffer from other issues such as street repair, drainage, water & sewage, animal and pest control, cleaning up the community, fire and police with adequate personnel and equipment, etc. You stated that the "facts come first", so what are the facts?

Factfinder21-In response to your 9:47am comment: It's evident of the city council members length of time in their positions and yes new members (as with anyone in a new position)will make mistakes. So are you stating that none of the 4 city council members are seasoned in the position? Gould seems to be a small community and usually in a small community everyone knows everyone. So why and how was the new council members voted in if none of them have a political background or at a minimum some form of legal exposure? Is it not the same "public" that is "down on the 4 council members", the same that voted for them? It appears that the "public" should have reviewed or received a synopsis of all of the candidates' history (good and bad) so that they would have known the type of representation that they were putting in place. This way maybe what is going on now could have been avoid? Yet, a fact is past mistakes does not keep one from becoming a representative of others (city, state, country, etc., if it did presidents, state representatives, etc. would not have been put into office. Also, it seems that the only time that the city of Gould get media exposure is when the city council and the mayor can not work together. Have you reviewed the DVDs from the previous years or the news archives? Now you have said "mis-worded" ordinance. Was it not proof read for law compliance before it was presented? Is it possible that it became "mis-worded" when it was challenged? Finally, how can the mayor deny to provide the city or anyone public records. FOIA, which is a federal law was established to ensure that the public is allowed access to certain information. As a note: Reader's focus writing is a skill that should be practiced. Your 9:47am comment exhibits an angry tone.

just like lib democrats to try to silence the opposition..Guess what, you can't do it..There's a little thing we have here called the First Amendment..It protects everyone's right to assemble and speak freely, even if you don't like what their speaking about or against..Go move to Cuba or some other commie place where you lefties belong, since you want to crap all over our constitution..

FJM347 - Reference your 5:34 am comment: I agree 100% that you have a right to know what is going on in your city and to voice your opinion. However, if you live Gould are you allowed to ask questions at your monthly city council meeting? Are you given documents requested under the State Freedom of Information Act? Why is Gould any different? What should the Citizens do? Who is responsible? Who will correct the these violations and restore the rights to all the citizens?

KoSla: Reference your 9:05 AM comment:I am very confused, if the city allegedly took control of the building in late October 2010, how long has the various organizations been meeting in the bank building? During this time period, did anyone offer to pay rent on the building? If so was it turned down? Who was the contact person between the city & the various organizations? Did someone "drop the ball" on this issue. Please don't forget, the Four council members did not take office until January 1, 2011. Has an offer been made by the various organizations to pay rent since they took office? If so, has the council been informed & given a chance to vote on the issue?........The Facts Come First!

The Four council members made a mistake! They have been in office less than a year, have been without a city attorney for months and have tried to obtain information & records from the Mayor. The public who is down on the Four current members, should look at the past record of the mayor & one council member in Federal Court Documents. If possible, view the DVD disks of the council meetings for the past 4 months,then make up your mind as to who has violated an individuals rights! Everyone is aware that the "misworded" ordinances cannot be enforced and will be repealed. Hopefully the Four council members will be able to obtain the documents and information they have requested from the Mayor. If they are denied, then tell me, who will be guilty of violating an individuals rights?

There seems like there's an hidden agenda behind what Council Member Hall is saying (city can't afford to pay the utilities/ get your own building). Sounds more like excuses, anger, and spitefulness. Especially when the city members/organizations pay dues and are willing to rent the building. There are buildings in the city that are rented all of the time.. What's really going on here?

It seems that the city council (practically 4) is working against the city than for the city and that they are looking for a way to justify ignorance. It appears that they want the mayor to be a silent puppet (and they are the puppet master). There are some extremely intelligent people in Gould, but the city keep electing the least of them (reading and writing is fundamental).
