Homeowner on trial for killing trespasser

A Sherwood man charged with manslaughter for killing a teenager on his property was in court Tuesday.

Larry Staley claims he accidentally shot Bryant Cross while protecting his family, but the prosecutor says he was trying to protect his property and acted recklessly.

In opening statements the prosecution said it’s very likely Bryant Cross was in Larry Staley's yard to steal but that he posed no threat to the family and that Staley shot while Cross was trying to get away.

Several witnesses were called including police officers who testified that they had previously warned Staley about shooting at people on his property.

A former city engineer who testified said Staley told him, some months before Cross's death, that police were not doing anything about theft on his property so he would. He also said that he had a plan for when thieves come back; that plan was that he and his wife would both come out with guns to confront them.

Prosecutor John Hout says Staley took the law into his own hands the night Cross died and his reckless actions cost Cross his life.

The defense contends Staley fired shots into the air from his back porch to scare the thieves away. It was the second time they'd been to his home that night and he felt his family was in danger.

John Wesley Hall, Staley's attorney, says Staley never meant to hurt anyone and never knew he had shot Cross until his body was found in the creek some 12 hours after the incident.

This trial is set to wrap up Wednesday. Staley, along with his wife and two of his children are expected to testify.

I agree with him about wanting to move out of Sherwood. Those cops are awful. I live in Sherwood myself and can't wait to get out! Those cops will follow you around and harrass you so you do something wrong so they can pull you over and ticket you. They go way OVERBOARD!

Mr. Staley, you are my hero. I hope everyone stands up for this man and his family! I firmly believe that you have a right to protect yourself, your family, and everything you own. I have always preached to my children that you NEVER mess with anyone else's property. In this situation, this kid did not respect another person's property and he got exactly what he deserved. Some may say he didn't deserve death, and although it is a tragedy, this kid shouldn't have been there. But he was and therefore, he took any consequences of his actions in his own hands. Mr. Staley is not the criminal here!

So the Justice System defends the trespasser once again. Should we let these thieves just take what we have worked hard for with out a fight? The man has a right to protect his property and his family. I don't believe he meant to cause the theif any harm, but to scare him away. If a thief is caught breaking in and is struck in the process and he dies the defender is not guilty of his bloodshed. (Exodus 22:2) That's the word of God!

In the first place if the kid was never on his property and stealing, this would not have happened. People need to step up and place blame were blame belongs. Jeesh
