Judge Denies AG Motion To Dismiss 12-Week Abortion Ban Challenge

A federal judge denied a motion to dismiss the legal challenge to Arkansas' 12-week abortion ban Wednesday.
LITTLE ROCK, AR - A federal judge denied a motion to dismiss the legal challenge to Arkansas' 12-week abortion ban Wednesday.

In a 9-page order, federal district judge Susan Weber Wright says the plaintiff's challenging the new law can move forward.

Attorney General Dustin McDaniel's office argued on behalf of the state that the plaintiff's had no standing to bring a lawsuit because the law does not take effect until August.

Physicians Louis Jerry Edwards and Tom Tvedten who provide services at Little Rock Family Planning Services Inc., brought the challenge against the Arkansas State Medical Board in April.

Wright will hold a preliminary hearing on the case on Friday.
