Jury considers lawsuit against former officer

FAYETTEVILLE, Ark. (AP) — Jurors are deciding whether a former Bella Vista police officer used excessive force when he shot and killed a 41-year-old man.

The federal jury will resume deliberations Thursday. They're considering a civil case against 29-year-old Coleman "Duke" Brackney, who shot and killed James Ahern after a high-speed chase.

According to the Northwest Arkansas Times Brackney testified that he fired the fatal shot because he thought the man was going to back over him in his car. Ahern was killed by a shot to the back.

A dash-cam video gives no indication that the back-up lights on Ahern's car were on.

Brackney pleaded guilty to negligent homicide in December 2010. The Bella Vista Police Department determined that Brackney violated policy by firing his gun after Ahern's vehicle passed him.

really the cops in this entire state are thugs...go hire some Military Veterans...more than half the training is already done...all the Veterans i know,including myself,would love to be"back in Uniform"...you wouldn't have a wrecked squad car every week (little Rock)...you wouldn't have a Gun going off while a fat man goes to the bathroom and then trying to cover it up...you wouldn't have a service weapon at a freakin crime scene...need i go on...i'm telling you...go hire some Vets...even hire some older vets...say 50...they would have 15 good years of Law enforcement...if they hired a 50 year old Veteran...15 Good years...with a whole lot of common sense brought to the table on day one...however...this will not happen....they are totally terrified to hire anyone who can actually think for themselves...bunch of mindless brainless idiots...and thats how they want it kept...that "blank stare" you see on a cops face is not a "thousand Yard" stare from seeing too much...people thats really all thats there inside...you get a blank stare because there's nothing going on upstairs

Police Dept.'s are really getting a bad name in the Natural State. Like I said maybe the FNI should take a look at all of them.

Bella Vista is a city isn't it. I didn't think it was a county. ASP is an organization of officers that covers the whole state. Others have much smaller jurisdictions set by suck things as city limits, county lines,and others.

bella vista is in Arkansas, aspmom, Arkansas State police meaning any police officer working in Arkansas police department, i know they have different counties

Negligent homicide is a joke. Murder is murder. If you kill someone, it is murder. The cop wont get more than 15 years for this.
