Jury finds man guilty in road rage deaths

The jury has found James Holian guilty on all four counts of first degree murder in last September's car accident that killed 4 family members.
CONWAY, AR - The jury has found James Holian guilty on all four counts of first degree murder in last September's car accident that killed 4 family members.

The prosecution argued Holian played a major part in the accident. Prosecutors say Holian instigated a road rage war with driver Russell Johnston, which ultimately ended with Johnston crossing the center line, hitting and killing four members of the San Felippo family September 12, 2010.

Thursday, on the witness stand, Holian erupted, saying the legal system is flawed and he is tired of being treated as though the constitution reads 'guilty until proven innocent.'

"If you've been in jail for a year, in this situation, with a bond of half a million dollars that you couldn't make, I can see how you would feel like this system is being unfair to you," said defense attorney Frank Shaw.

"You feel the stress that's on the jury because they're having to make a decision that none of them will ever forget. This is a case that everyone involved will remember for the rest of their lives, regardless of the outcome," said Shaw.

Russell Johnston, who is also charged in relation to the crash and the four fatalities, is scheduled to go on trial in November.
