Larry Staley case declared mistrial

The jury could not reach a verdict in the manslaughter trial of Larry Staley so the judge declared a mistrial. But Staley's troubles aren't over, the prosecutor plans to retry him and he is still in jail.

"A mistrial was declared but Larry Staley isn't going home, he's going to the Sherwood jail on weapons charges."

The jury deliberated four hours before coming out and telling the judge they could not reach a verdict. Six believed Larry Staley acted recklessly when he shot and killed Bryant Cross in his yard, but the other six jurors weren't convinced. While Staley hoped for a not guilty verdict.

"I didn't see how they would find it otherwise," Staley said.

Bryant Cross's family was confident the jury would find Staley guilty; they're disappointed by the mistrial.

"The evidence was overwhelming. Don't see why the jury didn't see overwhelming evidence," Cross’ uncle said.

Cross' family is happy to see Larry Staley go to jail. During the trial, Staley testified there are guns in his home.  Police executed a search warrant and found them. Staley is a convicted felon, not allowed to have firearms, he was arrested right after the trial.

"They arrested me because Earlene bought a gun because of all the threats.  The gun is in her name, she purchased it," Staley said.

Bryant Cross’ family says they'll be back for the next trial and they hope the second time around justice will be done.

The prosecutor plans to retry Staley he hopes to have a new date set as early as Monday.

my name is johnnie staley my dad is larry staley he's still in jail but should be home shortly its just crazy to understand whats going on. im so glad most of u supported my dad and my family. and the ones that didnt i understand because i know u dont know my family and what happened but if u did u would support us i dont blame you tho. thank you to all of u tho

I wish there was something we could do as citizens to back Staley up. Legally of course, were not going to stoop to Cross' level are we? What makes me chuckle is how 85% of people that are placing the blame on staley are, or were criminals at some point in their lives. You can tell just by looking at and listening to Cross' family that they are thugs. They obviously need a little help from the parenting fairy because if Cross and Dunn had been brought up right, none of this ever would have happened. Im not proud to know either of them but I went to school with both of them and they were both equally ignorant and ill mannered! It was only a matter of time before they became stupid enough to try to rob someone, or in Dunns case, rape and theft. They stole because no one would give them jobs, but what I don't understand is, if they planned on stealing ATV's, where would they ride them? If they were too stupid to take into account that they WOULD have gotten caught, had they actally stolen them, they aparently werent smart enough to realize that they could have gotten killed. Unless they were planning on selling them, which was peobably the case...

What parents taught their children to tresspass others people property at night. I'm just saying in general. But as explained below by chokgal; Staley is wrong. If they "were running away" from the property, there is no need to fire at them. If Staley wants to feel assure he should've just shot up in the air, i don't know if thats ok too.

Cross would be alive today if he had stayed off of Mr.Staley's property,I think its time we stand up and take back our streets from the thugs that are running rampant.If more people are shot as they try to steal,rob,rape and murder maybe they will stop!

Lorelei-here's a report when this first happened that details the felony conviction: The threat was no longer present on the premises," says Prosecuting attorney Larry Jegley. Jegley says the suspected robbers Lamarcus Dunn and Bryant Cross were running away from the house when Staley fired shots. Jegley explains, ?The law, while it does recognize you?re right to use deadly force in certain circumstances it demands that you not be reckless." Once the investigation began, police quickly learned that in 1986 Staley was convicted of felony sexual assault on a child in Texas. Three years later he violated his probation and served 10 years.

To Lorelei- Mr. Staley's felony conviction stems from either molestation or rape charges of a young girl.

This is copied from my post on an earlier story with an addition of the last paragraph. Mr. Staley, you are my hero. I hope everyone stands up for this man and his family! I firmly believe that you have a right to protect yourself, your family, and everything you own. I have always preached to my children that you NEVER mess with anyone else's property. In this situation, this kid did not respect another person's property and he got exactly what he deserved. Some may say he didn't deserve death, and although it is a tragedy, this kid shouldn't have been there. But he was and therefore, he took any consequences of his actions in his own hands. Mr. Staley is not the criminal here! I believe we should all go to the courts parking lot with any future hearings or trials and protest his being on trial. We have to start standing up for what is right people! Enough of the bullying by this insane power hungry people. Remember... We the people... WE are the government, all of us. Not just a select few like the Sherwood authorities.

Mr. Cross knew the consequences of his actions. I am a gun owner myself, I am twenty-five years old and learned to shoot a gun when I was eight. And I am female. I believe in the right to bear arms and the right to protect my family and property that I work hard to keep and maintain. Maybe Mr. Cross' family should get their heads out of their asses and realize that their son was a screw up and made wrong choices and ultimately paid for those mistakes. No one is to blame but him. Keep your head up Staley family!!

well i say again if the cross's would have raised there son better then he wouldn't be dead.MR. staley did what comes natural to a father and a husband...and if anybody says they would have done different they are only lieing to theirselves..i think the cross's need to be charged with neglect since evidently they didn't show their son the right road to go down.....95% of fathers would do the same thing.... who in there right mind is going to set there and let some crack head theif steal everything they have.....Mr. staley as an american tax paying citizen i'm on your side....and i will do the same thing if i catch a drug useing thug trying to steal anything i have on any of my properties......
