Lawsuit filed over $1M winning lottery ticket

BEEBE, AR - The life of a losing lottery ticket - thrown away and forgotten until someone realizes the loser is actually a winner.

Someone bought a $1 million dollar scratch off ticket at the Super 1 Stop in Beebe back in July.

Whoever bought it tossed it in the trash - and that's where all the controversy starts.

Sharon Jones and her husband are million dollar winners after finding a discarded ticket in this trash can. But Lisa Petriches, the manager at the Super 1 Stop sued in White County circuit court, saying she should get the money.

According to the lawsuit, losing lottery tickets go into a trash can labeled "do not take", for a shot at a second chance drawing.

The ticket in question hadn't been completely scratched and turned out to be a $1 million winner.

It's a million dollar ticket - with almost as many opinions.

"I don't think the store has any right to it," says Linda Schneider.

"If it's clearly marked, then it should go back to the store," adds J.D. Goldman. "’Do not take’ means ‘do not take.’"

Now, the smiling couple can't spend their winnings until the legal fight for the left behind lotto ticket gets resolved. Their attorney filed a motion to dismiss the case late this afternoon, saying the "do not take" sign on the trash can didn't show up until after his client pulled the winning ticket out of the trash.

The lawsuit argues the trash can is the property of the store manager, and that the Jones couple committed fraud by taking the ticket out of the trash.

The Arkansas Scholarship Lottery did not respond to a request for comment.

A judge has ordered Jones to not spend the prize money until the case is resolved.

The lady who found this tickets if her lawyer is smart enough should take this to a higher court ,because if you call any lottery office they will tell you if your name is not on the back then how can any one say it was theirs in the first place.The lady who found tihs its ritefully hers in my eyes .an like i said i buy rolls of scracth offs an if i know to do this then she should of done this too.I bet she wont throw any tickets aways at all again.If I did some thing so stupid as to do this an it was my ticket i would of shared this with the other person but im not greedy at all.because half the money is better then nothing .but im not on the side of the person who threw the ticket away at all really

The lady who found the ticket to me is the winner .I dont care what any judge says this lady threw it away unless her name was on the back how does she know it was her ticket really i just saw the lady who threw the ticket away on tv ,shes very greedy really.i was told by a lottery place unless your name is on the back of the ticket its not yours if you loose it an others find it.an the judge i dotn think much of him at all.,how can he say its hers it didnt have her name on it at all, an the store worker is wrong also for telling this sharon duncan any thing .when i buy a roll of scratch offs an i do this quite often an i find a winner the first thing i do before i get it scanned is write my full name on the ticket an address .then i get it scanned ,im sorrie the lady who found it is the winner as far as im concerned an the lady who threw it away is being greedy! An the judge is being bias really ! an if this lady has to give the money back then sharon duncan needs to do the rite thing an stop being greedy an let her have half of it is the rite thing to do.i watched the lady on tv who threw the ticket away now shes loooks like a real gredy person she showed shes greedy too,.she needs to be ashamed of her self .to be so greedy.she will have to answer to god one day for being this way really ! wonder what time her broom leaves the depot!

Ok so if it had made it to the dump. Would the store manager still think she would have claim to it .... Of course NOT finders keepers. the right thing to do is go through the security tapes to see if they can identify the person that bought the ticket and return it. However that would be the chrischen thing to do "LOL""ROFL" yea we all see that happening again American greed at its finnest!!! Sorry about the worker but they are compensated by the hour to be there working not going through the trash checking koto tickets. If that were my employee they would be working somewhere else by now!!!

The issue is legal ownership, and the precedent here has been clearly established in law. Once an item has been placed in the trash ownership has been forfeited, regardless of who's property the trash receptacle is on. For example, law enforcement can rummage through a trash can on someone's property without a warrant. In this case it should be finders keepers. However, the cleanest solution would be for the Jones' to split the proceeds with the station owner; the manager should have zero claim on the ticket unless there was some form of agreement in place wit the owners regard discarded lorry tickets.

Okay people, listen. If you read the back of a lottery ticket it states: "Lottery tickets are bearer instruments" That means, that you have to have the ticket to claim any money. The person who scratched it and was stupid enough to throw the winner out, NO longer is the owner of the ticket. Neither is the person that works at the gas station. I can see why she thinks she is entitled to it, because she probably checks the tickets all the time and finds winners (I work at a gas station, and have found multiple winners in the garbage cans). So once she heard the news was probably extremely angry that she didn't get to it first. And I def. understand that, that sucks! But, she didn't get to it first. The Jones couple did. How would you feel if you were walking down the street and happen to check a ticket on the ground and it was a million dollar winner? You found it, YOU KEEP IT, unless somebody wrote their name on it, if they didn't, ANYBODY can claim it, unless you are the person who signed the back of it. Sorry folks, that's just how it goes!

Patches is crazy... If you purchase a ticket, scratch it, determine it is not a winner and discard it into the trash, you have given up ALL rights to that prize!!!! This store worker has no right to claim other peoples trash, nor the right to sue this women for finding a winning ticket.. This is an absurd suit and this person better be given her money to spend soon!

The Manager can not claim lottery ticket just because she thinks the discarded tickets are hers. They are not hers. She has no morals if she thinks it is fine to take money from someone for a lottery ticket and when they by mistake throw the wrong one away claim it for herself. She is an employee of the gas station and that is not her ticket. Let her buy her own tickets not take a paying customers ticket. The lady that took the ticket has no business doing so and should just give it up to the college grant fund. I do not understand how anyone could take any one that is not theirs. That is what these two are doing. The ticket belongs to whomever paid the $20 for it not the manager nor the trash picker. I think they should get some jail time both of them. This is not right and the court should void both their claims because it violates public policy of thief. We can not as a society let people steal other people property even if it is just a lottery ticket that no one knew was a million dollar winner at that time. the lady that cashed it in knew she did not buy it and I find it hard to image that the lottery commission would allow a person to claim a million dollars from a lottery ticket they found in a trash can that was not theirs. Sounds fishy to me.

No matter how you try and justify the Jones taking then cashing in a million dollar ticket it does not belong to either one of these ladies. The ticket was placed in an trash can belong to the gas station and not to an employee. The employee receives a pay check and is an agent of the owner. She/he can not claim a lottery ticket out of the trash can as her/his own. The trash is on the gas station owner's property not the employees property. Therefor is not her/his ticket is the one who paid for it's ticket and if he/she is not found then it is the gas station owner's ticket. The manager has no rights to the money. She nor did the lady that took the ticket pay for it. The winner may have looked at it to fast and threw away the wrong ticket. The lottery has caused nothing but issues in the sate since it started. Like tax problems. Now this, lady takes winning ticket out of the gas station owner's trash can and cashes it in saying she told them found in trash can. I believe that story like I do when a kid eats something that was not his. Then says I did not do it with the food all over his mouth. These 2 can not be allowed to just take the lottery ticket and cashing it in without being the ones that paid for it. If you can just take a ticket out of the trash and cash it in why not just take one of the roll then cash it in? You can say the same thing I found it in the trash can. My point is why should we buy them and then accidentally throw it away and then someone take it? the trash is not the manager's property to do as she wishes. She lucky to have a job without taking trash off her employers property. The money is evil and does not belong to either party. They did not buy the ticket how can they claim it? Well I pay for my tickets. I guess I should just get mine out of the trash to if they can take someone else ticket and cash it in why can I not?
