Lawyers say Gould ordinances violate Constitution

GOULD, AR - "I couldn't believe that it was real when I first read it," said UALR School of Law Dean John DiPippa.

Disbelief is a common reaction to Gould's latest city ordinances.

"The truth is the city of Gould doesn't have the authority to tell anyone that they have no right to petition them, no right to speak and no right to exist in their city," said DiPippa.

But that's just what the ordinances do - disbanding a citizens group, forbidding the Mayor from meeting with people and stopping any groups from forming if members discuss the city without council approval.

"The fact is, if it's aimed at this group, it also extends to you talking to your mother or a church group or any other group that wants to form. A garden club! It's so broad that it can't possible comply with the First Amendment," said DiPippa.

"Pretty clearly, they go way beyond what is necessary or what is lawful," said Council Mark Hayes with the Arkansas Municipal League.

That's even what Gould's city attorney told the council.  In return, members tried to fire him.

"That's why you have a higher court," said council member Sonja Farley. "To keep order when people can't keep order. That's why you have a council!"

"With this city council, it's their way or the highway," said Gould Mayor Earnest Nash. "They act more like Napolean Bonaparte. Total domination."

The goal of the ordinances is to releive friction between city leaders and groups.  But the Mayor argues this is a false problem to write in an ordinance.

"This group doesn't cause friction between me and the council. The council causes friction between me and the council," he said.

"Unfortunately, it's probably going to lead to a lawsuit, embarrassment and an expense for the city of Gould because this has no chance of being upheld in a court," said DiPippa, adding, according to the ordinance, the conversations Fox16 had with the mayor, council members and the Gould City Advisory Commission on Wednesday were against the law.

"Technically, when they met with you, they violated their own ordinance," said DiPippa.

The mayor says he believes the council is purposefully trying to lose the city's charter, but he doesn't know why.  In June, he struggled against council members voting against accepting an $800,000 grant to repair the city's sewage system.  Nash says that was the beginning of his rocky relationship with certain council members.

These people are oviously Fascist and they have no respect for their fellow man or their Country. America needs to wake up, get out from in front of their T.V.'s and out of their Churchs and start attending these meetings and let their Voices be heard before it is to late. It is our own faults that we lose more and more Constituitioal and Civil Rights every day. While we are all out working and entertaining our selves, the evil people are busy having meeting and writing laws that make us all criminals. The next thing we will lose is our gun rights which are slowly being removed behind our backs. Then everyone will end up in all these new Prisons (FEMA Camp's) that the Government is building in every little Town in the U.S.. This is all a plan and on New Years Eve while you we partying big time, Obama was signing away all your rights under a new law that allows the Government to declare any American Citizen a Terrorist and put us in prison without the right to a trial. The exact same thing that is happening in Arkansaw is also happening in all small town America. Google Quartzsite, Az., Mesquite and Pahrump, Nv., and other and the stories just repeat themselves even to the extent that they are arresting people for speaking out when being told to shut up. Once these people are elected they turn into control freaks and turn coats every where. They join and attend brain washing seminars orgastraighted by a group called the League of Cities and Counties that are paid for by your tax dollars. They go to classes to get their egos pumped up and are trained on how to handle all of us malcontents in the audience by ignoring our suggestions and insulting our intelligents when we not to agree with their big wasteful spending schemes and scams that 99% of them come up with. It is all part of a much larger plan called New World Order. True that most of their kind only make it one term but they can line their pockets and do vast irreversible damage during that time.

seattlpatriot- After watching all this and reading what we are allowed [via USA Pravda news] I'm inclined to think you may well be right. What a better place to start? Rural areas will be the ones hardest to get under the thumb. So if you get them out of the way first.Guess they couldn't buy the mayor off. That city council is scary as things like this tend to spread like a slow moving virus. I don't think they expected it to draw so much attention. For sure they under estimated the mayor. The rest of us should maybe check out our own little city councils now.The police seem to be almost non-existant. Hopefully the rest of the country don't judge all Arkansans by these ones. They probably will though. With all the other things going on in Washington it should raise a red flag to all Americans for instance dhimmitude. Google it and then go to page 107 of our new health care bill while we were kept so busy with the mexican border but nothing on the Canadian front. Jihadists in France which is an open door to Canada and an easy walk across there. Thank you channel 16 you don't make people pay for their opinions to be put out. That's real Freedom of Speech. You don't have to pay for it.

Sure is a suspicious deal to me. Why this litle town? Is something getting ready to come there people don't know about? That city coucil is obviously trying to lay the ground work for something. Maybe small towns is the place they are going to start a larger agenda. Can't think of any other reason except over-bloated ego's on their city council.

It sounds like the council is inviting the feds in to take the city, probably because they're all Koch and Rothschild employees. Whoever the city is going to go to, when the charter is lost, those are the primary suspects as to who is engineering the "city council's" debauchery.

Gould has never been much more than a miserable little speed bump in the flat steamy mosquito-ridden delta land along Highway 65. Accordingly, the politics there has always been petty and mean. Why? I don't know - perhaps because the stakes are so small.

I think the possible explanation may lie in the mayor's own words: "It's like they're trying to lose the city charter." Hmmm... is there a financial profit somewhere in losing the city charter? Do any of the members of the city council stand to gain? When things which defy explanation occur, especially in today's world, 'follow the money' should be the first line of inquify. /Qui bono/? Who benefits?

No groups can assemble. I guess only one customer in the building to get a hair cut or styled. Only one person in the grocry store at a time to buy groceries. Only one person in the Church. Kinda makes it hard for a weddding. Not to mention getting a two thirds vote just to get married.

People need to assemble and oust these kind of people from city council! Of course, they're just following the example of Our Dear Leader and acting outside Constitutional authority. How much are you going to continue to take people?
