In Hot Spring County the superintendent of the Malvern school district claims dozens of parents are breaking the law by sending their children to schools outside the district.
Parents however say they're taking their children out because they're exercising the school choice act. Malvern school officials say the act is being violated.
Now parents are asking a federal court judge to grant an injunction to keep the kids at their current school until their lawsuit is heard.
"The basis of the lawsuit is they are not being allowed to take their children to the school they wish for them to attend under the school choice act. They are not being allowed this due to race and that's the sole criteria," says mother Andi Davis.
For every student that leaves the district Malvern loses more than five thousand dollars.
