FAYETTEVILLE, Ark. (AP) — Fayetteville police are trying to determine whether a man who was fatally shot after he broke into an apartment had some kind of impairment.

Investigators say David Butt killed 40-year-old Matthew Taylor early Sunday at the Lakeside Village Apartments.

When officers arrived, they found that Taylor had forced entry into the apartment through the window. They said Butt confronted Taylor with a handgun and was ordered to leave.

Taylor complied but later returned through the same window and was shot by Butt. He died inside the unit.

Police are awaiting the results of an autopsy, but say it's possible Taylor thought he was breaking into his own apartment.

The buildings at Lakeside Village Apartments are identical.

Did the resident call the police the first time the guy came crashing thru his window? Impaired or not, he committe a crime of breaking and entering/burglary or whatever they want to call it. He violated the residents rights by breaking in. I would have shot him the first time, there never wouldve been a second time around for him.
