Mayor: Fence on public property will have to move

The City of Maumelle is preparing to send out letters to 24 homeowners, telling them they need to move their backyard fences off of public property.

Here in California, such an act, not noticed nor acted upon by a city, would have resulted in a permanent easement being awarded to the homeowner. I would suggest that someone skilled in Arkansas law examine what would constitute an awarding of an easement. I wouldn't move my fence a single inch without seeking a learned opinion first.

The fences were in place before that area became part of Maumelle. The builders/homeowners did not know at the time they were erected that the fences were on "public property". If the mayor wants it moved, the city should foot the bill to move it rather than burden the homeowners for something that is not their fault. If these people intentionally built the fence outside of a right of way or into an easement, then I can see making them pay for it, but not in this case.

If the City wants it moved, they should pay for everything, if the Mayor is doing his job like he is hired to do, there should be plenty of money available with all of the new housing, apartments, and business taxes. Or, maybe Watson needs to do like Osama, time to go.

Why in the world is Maumelle crying over two feet?? What are they going to do with the two extra feet except to have more grass to cut.

I live on what used to be a corner lot. We closed a road between me and a neighbor. You should what they want for utilities right of way. 20 feet. So I have 20 ft on one side I can do nothing with but mow. 45 feet on the other. Crying about 2 feet seems like little to me.

Under Arkansas State law if a fence is in place over 7 years it is considered the property line. If Maumelle wants the fence moved they will have to pay for the new fence and pay current market value for the 2 feet of property. Some one needs to let those people now that.

Some one needs to tell those people that under Arkansas State law if a fence is in place over seven years, That is considered the property line. So by State law if Maumelle wants the fence moved, Maumelle will have to foot the bill for the new fence and pay current market value for the 2 feet of property

if it was there before city of Maumelle than they should not have a right to do that
