LITTLE ROCK, Ark. (AP) — The Arkansas Supreme Court says the state can seek the death penalty again for a man convicted of capital murder in the killing of a Pine Bluff teenager.
The court on Thursday rejected Kenneth Osburn's argument that prosecutors couldn't do so because it would amount to double jeopardy. Osburn was sentenced to life without parole when the jury deadlocked in the penalty phase of his first trial.
Seventeen-year-old Casey Crowder was found in woods near Dumas in August 2006. She had been strangled.
Prosecutors sought to retry Osburn after the state Supreme Court overturned his conviction on grounds that investigators continued to interrogate him without an attorney even after he requested one.
Osburn's lawyer, Patrick Benca, said he may appeal the decision to the U.S. Supreme Court.
