Retrial set for Arkansas death-row inmate

BENTONVILLE, Ark. (AP) — A new trial has been scheduled for an Arkansas inmate whose murder conviction and death sentence were overturned because one juror slept and another posted on Twitter during the court proceedings.

Judge Jon Comstock scheduled an Aug. 27 trial for 26-year-old Erickson Dimas-Martinez, who was convicted in 2010 for the death of 17-year-old Derrick Jefferson. Last month, the Arkansas Supreme Court overturned Dimas-Martinez' capital murder conviction and death sentence because of juror misconduct.

The high court ruled it was inappropriate for the juror to tweet about the trial, even though the juror did not mention specifics of the case.

The Benton County Daily Record reports that prosecutors will again seek the death penalty.

The judge also scheduled pretrial hearings for March 14 and Aug. 8.

Butch54 , I agreejurrors should be held responsible for any misconduct. They hold someone elses life in their hands. You can bet if it were them in the hot seat they would feel the same. The juror that was sleeping bothers me the most. How can you make a true decision on any thing if you missed part of the facts. If you are asleep you have no idea what you missed. Totaly unfair to the person on trial. And a waste of our money.

Push your law makers in your area to introduce bills that would make jurors responsible for this type of misconduct. Criminal and financial. Save our tax dollars. Wonder how much this will cost us. Another thing. Never put things where they can be used against you. Word of mouth is debatable writing and posting is not.
