Roland man acquitted of murder in baby's death

SALLISAW, Okla. (AP) — A Roland man has been acquitted of murder — but convicted on a lesser charge — in the shooting death of a 1-year-old who was killed during an apparent robbery.

The Southwest Times-Record reports that a Sequoyah County jury convicted 22-year-old Devin Jeremiah on Thursday of shooting with the intent to kill in the March 2010 death of Elaine Keene of Van Buren, Ark.

Prosecutors say Elaine was in her car seat when her mother and two other men drove to Jeremiah's home to allegedly rob him.

Jeremiah was accused of shooting at the car after he was robbed and beaten by the two men, who have since pleaded guilty to robbery. Prosecutors say Elaine was likely struck by a bullet that passed through a tail light and trunk.

This story concerns only the robbery victim. An article published on this site in May stated that the 3 suspects in the case were all charged with first degree murder. And yes, the woman involved was the baby's mother.

While I'm so happy this evening what the he-- Id like to know is how Arkansas law effects this as it happened in Ok. I thought state laws stopped at the border. It's a shame a baby died. Blame. Why would a mother take a baby to a hold up. One reason. Stupidity. Also they started the action that caused this nut to shoot. I'd say it was a no brain act on the mother and the guy's she was with.

@happy to be me...there is a law against having a gun around a baby, Arkansas is cracking down on that crime and @shameless toucha with your name as well learn your facts before you start posting ignorance you may want to read the Arkansas laws when you get some free time and yes youcan start pointing fingers at the mother but you dont know their situaition the father could hve had visitation that day you never know, people are so quick to (blame the mother)if i was put in that situation but as a law abiding citizen (who plans to stay that way) i would let the law enforcement do their job, that's what i pay their salary for and also

I truely would like to know if the others have been charged with anything having to do with this childs death. Since they charged the victim. Does this mean they will walk free of any responsability ? Why in Gods name would he be charged rather than the others. I am about to be sick just thinking about them not being held responsible. Yes, they may serve some time for what they did to the victim, but nothing compared to what it should be for causeing the death of this child. I hope I read later that they have been chargrd with something to do with the childs death. Maybe , child endangerment,neglect, something.

I know for a fact there is a law .Not sure how it is written, if some one is killed while you are in the act of a crime you are guilty of that death. No matter if you planed it or not. I can it see no other way , the mother is the person responsible and the people she was with are just as guilty. The fellow that was robbed and beaten has done nothing wrong.And As some have said he will have to live with this the rest of his life.

Why didn't he call the police? Says he was all beat up and they had left so he shot at the car? Wonder if he thinks he had anything worth the bay's life? The people that did it to him should also have charges for this baby's life. Bad judgement to shoot at a moving car his bullet could have killed more innocent people. We want our guns then we are responsible for what we do with them.

shameless is 100% on the money, the so called mother should be in prison for the rest of her life, this poor guy should never have been charged, it will be bad enough that he has to live with it the rest of his life.

It is really sad all the way around. I don't think the robbery victim, who was probably shooting to protect his own life, should be charged at all. He will never forget he killed that baby, that is punishment enough. I think the three in the car should be charged for the baby's death. Especially the mother for having the baby there at all. God bless her little soul.

why is this man even charged with anything, he probably had no idea there was a baby in the car, the people who robbed and beat him should be charged with murder.

What about the mother? She is more guilty of this murder than anyone. And she's probably pregnant again already.
