SALLISAW, Okla. (AP) — A Roland man has been acquitted of murder — but convicted on a lesser charge — in the shooting death of a 1-year-old who was killed during an apparent robbery.
The Southwest Times-Record reports that a Sequoyah County jury convicted 22-year-old Devin Jeremiah on Thursday of shooting with the intent to kill in the March 2010 death of Elaine Keene of Van Buren, Ark.
Prosecutors say Elaine was in her car seat when her mother and two other men drove to Jeremiah's home to allegedly rob him.
Jeremiah was accused of shooting at the car after he was robbed and beaten by the two men, who have since pleaded guilty to robbery. Prosecutors say Elaine was likely struck by a bullet that passed through a tail light and trunk.
