SEARCY COUNTY, AR – Searcy County Sheriff Kenny Cassell will remain in office, FOX16 has learned.

According to Cassell’s attorney, Joe Don Winningham, Special Judge Klinger dismissed the state’s case to remove Cassell from office Thursday afternoon.

In 2011, Prosecutor Cody Hiland filed papers to remove Cassell from office because of a misdemeanor conviction in 1979 for knowingly possessing stolen Cornish hens.

Hildand tells Fox 16 that he respectfully disagrees with the judge and believes the judge added a condition that is not currently in case law. Hiland says he needs clarification from the Supreme Court relative to this issue.

All valid points Butch; I bow to your wisdom - on this one. Never thought I'd see you defending a LEO though!

A life long friend of mine lives and owns a business in that area. She says he does a great job. 1979 is a very long time ago. It wasn't a felony. The people there seem to like this guy. They voted for him knowing it. Leave him alone. We are talking about a misdemeanor 30 something years ago. The funny thing is she also says they also voted heavy in that area for the prosecutor. She doesn't think they will again.

Why would anyone want a sheriff that was convicted of having stolen property?
