Suit by La. victims over Albert Pike flood dropped

A lawsuit against the federal government filed by Louisiana family members of three of the 20 people killed in a flood at a U.S. Forest Service campground in southwest Arkansas has been dropped.

Reading some of your posts makes me sick! You were not there. You did not have to fight for your life and the lives of your children. I was there! It has been almost two years and I still can't sleep through a rainy night. I worry about the safety of my children even when I know they are safe in their beds. We got there very late that night. There were not any signs warning us of flood waters. There were not any park rangers there to tell us to be cautious of the rain. There was not a raging river when we got there! It was a babbling brook that turned into a nightmare. So, for those of you who speak without understanding.... Shame on you! You are not allowed hurtful comments because you didn't experience that nightmare with us

Ok Ok everybody,I was not saying that these people were smart for choosing a bad weekend to go camping or camping next to a river but this is my point.... If people were in any great danger camping in this campground, then it should not have even been there. It's not like they just pulled up in some random woods and decided to set up the tent. It is a federal campground! It has designated campsites. So, it seems to me that even with the flood plain signs, these people thought they would be relatively safe since the government set up these sites...I mean our parks dep. wouldn't knowingly and purposely put us in harms way would they? Loop D was the main and first part effected and it had hook ups so mailny RVs were set up there. You are supposed to be pretty safe in an RV or camper right? Even if it rained right? WRONG! For whomever hasn't been to Albert Pike before or know exactly what transpired that early morning, you have no earthly idea of the magnitude of the horrific tragity that unfolded there. If you knew anything about it you would know that the damned river didn't just overflow and seep into the campsites. It was a flash flood that started upstream (actually miles away from the sites), filled up the gorge and sent water crashing directly into the campsite. This same thing happened before many years ago. My grandma told me that her mom and her were out there having a picnic when she was a child and it started to rain when her mom had a terrible feeling and they left. She said it was the same thing that happened this time around too. These people probably didnt know about that since it was before they were born. fact is, the parks dep. knew it and still chose to have a campground there even though the threat was still there. It is the governements responsibility to ensure safety to the people and not put a campground in a flash flood prone area.

i think that was a wise choice to drop a ridiculous lawsuit, now honestly all they did was mke their lawyers pocket nice.. WORD TO THE WISE: please dont camp by rivers or lakes that can potentilly "overflood" be safe and camp with caution

Why not sue the national weather service? Maybe they didnt give an accurate enough forecast. That makes about as much sense as suing the government. Or better yet, why not sue the one person responsible for bringing the rain, God.

Jeez people we are the government. I didn't go down there and warn them. Stop holding up our government like they are an outside body. There not. They are a group elected by us. That is the way our founding fathers saw it. I like it.

jeez...people whats distubing here is the inability of these people to sue the Government... the blatant exclaimation of the people in the government sayin we are above the law...what the inevitable next step...revolution...seriously where do we turn from here...if you can't do it legal...then what...our founding fathers pondered this same question...and it would appear...sadly...that we are no longer a republic...when the republic won't follow its own rules

You know the risk when you venture into the outdoors. I've never been to Albert Pike Campground but in my own opinion if there is signage put up warning campers of a flood danger then the Parks Department has already gone above and beyond to warn campers. This "I'm a victim" mentality and these frivolous lawsuits are only going to mess things up for the rest of us. If you need sirens or instructions to tell you that when a large amount of rain falls the river you are camping next to may flash flood, you have no business being outdoors.

Azrael, you stated that there are signs that state the area is prone to flooding, correct? O.k., have you ever seen a sign there that says "the government requires that YOU camp here"? I didnt think so. If they have signs in place that let you know that if it rains, it may flood, and no signs saying the government is forcing people to camp there, how can the government be liable? Did the park staff hold a gun to their heads and make them camp in that spot? Nope. Did the forecast not show that heavey rains were coming and flooding would be a certainty? Yep. I do not agree with a lot that the govt. does, but I cant sit here and place blame on them for peoples choices to camp in a area that has been known to flood during heavey rains.

I have kayaked this river since the 70's and camped there many times, it is not the Parks Service's responsibility to monitor every little incident. They warned us many times when we put in on the Little Missouri and the Cossatot but we were accompished paddlers and knew what we could handle. This was a freak accident and no one is to blame but the campers themselves.

Our government has many thing so much more important to worry with. Grown people have to step up and take responsibility in activities they choose. When enjoying the out doors you must keep up with the elements in it. Prepare your self before you even go. Watch the extended forecast of several sources and keep listening while your there. Read information on areas and about what your doing. I remember the weather at the time this happened. I think I can remember it calling for heavy rains and flood conditions. What else would you expect. A government agent to go in and take people by the hand and order them out. I don't see it being their responsibility. Then if they did people would want to file a suit for that. The best way to protect yourself is to always be well studied and prepared for what you under take. Not trust in our government, with their many other task, and blind luck. I don't mean to offend either and this is just my opinion. It is my right to express it. So many lost their lives that day and nothing will change it. It's like people driving through running water over a roadway. No matter how many stories there are on it some still do it. Is that the fault of our government. No. Camping in low areas in rainy weather is much the same thing.
