State Police Decline Investigation Into 107-Year-Old Man's Death

The search is on for a special prosecutor to take on a case involving a 107-year-old man killed in a shootout with a SWAT team in Pine Bluff Saturday.
PINE BLUFF, AR -- The search is on for a special prosecutor to take on a case involving a 107-year-old man killed in a shootout with a SWAT team in Pine Bluff on Saturday.

Before recusing himself from the case, Jefferson County Prosecutor Kyle Hunter asked State Police to investigate the events and circumstances that led to the death of Monroe Isadore.

State Police declined to take on the case and explained why in a two page letter to Hunter.

"The request must be made in a timely manner to permit Special Agents of the Criminal Investigation Division access to the shooting scene prior to the removal of evidence and before the officers involved in the shooting are permitted to be released and interact following witness segregation," said Arkansas State Police.

State Police also say they aren't investigating because such investigations are conducted and strictly limited to the use of deadly force by a law enforcement officer which is prescribed under an Arkansas Code.

Hunter and other Pine Bluff Officials wanted an extra pair of eyes on the Isadore case.

"We're really at a stalemate now until they render their decision," said Sgt. David DeFoor, Pine Bluff Police.

It's a decision that will now be up to a special prosecutor, since Hunter recused himself from the case for conflict of interest.

"If he or she determines that they need an investigation or need an additional investigation, then he could ask a law enforcement agency to assist. At this point, it's too early for me to know for sure how that will all come out," said Bob McMahan, prosecutor coordinator.

A judge ordered McMahan to appoint a special prosecutor to the case on Thursday. It's an appointment McMahan hopes to make soon.

"We do have a couple of people on staff here that serve as deputy prosecutors that become special conflict attorneys if their schedules allow for that. So I'll probably begin my search Friday," said McMahan.

Police showed up to Isadore's home after reports he pointed a gun at two people. He was killed after exchanging gun fire with a SWAT team.
