Teachers union fighting PCSSD over union replacement

There is a new round in the fight between the Pulaski County Special School District, PCSSD, and the teacher's union. A judge says the board had the right to decertify the union, but the teachers aren't happy with what the board has replaced it with.

The union believes the formation of a Personnel Policies Committee to replace the union was illegal because of the timing. Teachers say they want this issued resolved fairly so they can get back to educating children.

"It's been horrible, people just everybody not knowing what's going to happen and always people asking questions," says PACT member Loveida Ingram.

Ingram is among dozens of teachers in the PCSSD wanting answers and a resolution to a lawsuit filed on their behalf by Pulaski Association of Classroom Teachers, PACT.

The suit came about after the PCSSD voted to decertify the teacher's union. The judge ruled the district had the right to do so, however, questions remain over the legality of the formation of the Personnel Policies Commission, PPC, set up to succeed the union.

"The committee wasn't even formed until Friday. That's when they got it all together and that's why the law requires it be formed in the first quarter of the the next school year, because teachers are coming back, they have time to look at stuff," says Clayton Blackstock, PACT attorney.

PACT and some of the teachers want the judge to order the old policies stay in place for the next year, then make a smooth transition to the PPC. But school board president Tim Clark thinks no delay is necessary.

"It was created by teachers as the state law dictates and it was done right," says Clark.

It is a decision for the judge and one Ingram anxiously awaits.

"I just want it all over. I would love to be able to just go to work and teach," says Ingram.

Another worry for the teachers is whether they will have any negotiating power over contracts with the Personnel Policy Commission as they did with PACT. The district says they'll have some say so, after all the committee is made up of teachers.

The current agreement with PACT is set to expire July first at which point the Personnel Policies Committee will take its place. The judge wanted to take some time to review the case. He hasn't said when he'll make a decision, but no matter what the outcome an appeal is likely.

I think a few things that have been reported poorly here by fox 16. The first of these is the fact that the PPC was set up by teachers who are friends and in agreement with the four school board members who voted to decertify. So the fact that this is set up with people who are teachers really means nothing. Secondly the fact that the PPC is simply an advisory committee meaning that they just give the board suggestions. They have no actual bargaining power unlike what the school board has stated. I think that Fox 16 needs to actually do some in depth research into this matter and not just speak to members of the school board and take what they say as the truth. If they have been covering this from the beginning they should know that many times what they say is not correct and also many times straight out lies.

The School Board was ignorant on how to go about in eliminating the union until Judge Fox schooled them. Now it will be interesting to see how Judge Fox takes his run for the Supreme Court into account with the fact that School Board has ignored his two previous rulings.

Thank you, LaTresha. Judge Fox's April 8 order stated that "the PCSSD has the right to terminate the PNA [PACT contract] provided it can do so in compliance with Arkansas law." That is the crucial second part of any statement that Judge Fox may have made. The question of whether the PCSSD has complied with Arkansas law is what he is now considering. If it has not, then they cannot terminate the PNA. Without that second part, it sounds like the board was victorious today, which is incorrect. Thank you for revisiting this story, and corrections are appreciated!

Judge Fox has never upheld the board's decision to decertify the union. In fact, in his April 8 order, he ruled that the board's action in that respect was null and void. Judge Fox said that he could not rule from the bench today, so we will not know the outcome until possibly late next week.

I'd expect an incorrect news report from another station but FOX16? How about paying reporting the news accurately!

The April 8 ruling said the decertification was null and void. He has not ruled yet on the legality of what the Board has done now.

The judge said he had already ruled that the Board could end the agreement with PACT as long as they did so LEGALLY. The judge will be reviewing the testimony from court today as well as all the exhibits submitted in court today. Both attorneys must file post-trial briefs and THEN the judge said he would rule. The last brief is due to Judge Fox by Tuesday, July 7th. Get the facts straight!!!!
