Teachers union reinstated

The Pulaski Association of Classroom Teachers, PACT, gets a victory in its lawsuit against the Pulaski County Special School District.

Judge Tim Fox's order states that because the district did not have written personnel policies established at the proper time, its decision to decertify the union is void.  The ruling came down Monday morning. When FOX16 contacted PACT and the school district, it was news to them.

Although both sides have previously said where they stand on this issue, they each wanted time to read the ruling and to consult with attorneys before giving interviews.

Last December, the Pulaski County Special School District Board voted to decertify the Pulaski Association of Classroom Teachers’ Union.

The union countered with a lawsuit claiming the board did not have the right to do so. At a hearing two weeks ago, teachers sounded fed up with the issue.

"I just want it all over. I would love to be able to just go to work and teach," says Loveida Ingram.

An end may be in sight.  The judge in this case ruled that although the board set up a Personnel Policies Committee, PPC, as required by law, it did not have written polices in place, making its actions void.   It's what the union argued in court two weeks ago.

"The committee wasn't even formed until Friday. That's when they got it all together and that's why the law requires it be formed in the first quarter of the next school year.  Because teachers are coming back, they have time to look at stuff," says PACT's attorney Clayton Blackstock.

Monday's order states that the plaintiff’s contracts with the PCSSD that incorporate the terms and conditions of the PNA remain in full force and effect.

Late Monday, School Board President Tim Clark issued this statement:

"The Judge’s order also requires mediation between the two parties to finalize the terms and conditions of the contract.

The ruling today means the current contract will be in place for the next school year, PCSSD can still move forward with personnel policies committee.

If the policies are in place during the first quarter of the year, the board could vote to terminate next June."

The PCSSD board voted to decertify the union December 8, 2009. If this passes, it may vote to terminate the union’s contract.

memyselfi, have you been under a rock for the past year? You should get your facts straight before posting comments that are not factual. PACT has not asked for a pay increase! The Board voted 12/8 to withdraw PACT recognition after PACT and the PCSSD Negotiating teams reached an agreement. PACT ratified the contract before that date. The key question is why did the Board not ratify the agreement during the special meeting they called before their regularly scheduled meeting? The one that had the agenda item to ratify the agreement? The collective arrogance and ignorance of the majority of this Board of basic management practices and the legal responsibilities of their position has cost this district millions in wasted dollars. For what? Their EGO. How many freakin' trips to court and how much in freakin' legal fees is it gonna take before the School Board President and Vice Pres realize they are not above the law? "Both parties herein accordingly agree to establish procedures that will provide an orderly method by which the Board and the Association may meet, consult, and negotiate in good faith to cooperatively maintain, protect, and improve the well being of its teaching personnel. Therefore, the Board and the Association agree that they will negotiate in good faith personnel policies, salaries, and educational matters mutually agreed upon as referenced to A.C.A. 6-17-202. V" PACT negotiated in good faith, the School Board has not. At the expense of our children the school board has succeeded wasting millions of dollars in legal fees, unauthorized reimbursements, ect. that could have been better spent on fixing our dilapidated school buildings and reducing student to teacher ratios.

Someone asked why no one has a problem with the police having a union on the Little Rock Police story. The difference is they are taking pay decreases and PACT is trying to stick it to PCSSD. I also didn't see any signs that were about the kids or the education when they walked out in protest. The school board members need to get their stuff together so they can remove them again. Try to imagine the law abiding city of Little Rock getting along without the police officers for a few hours so they could protest. There would be riots. They are dutiful civil servants.

I wonder why my hometown newspaper the Batesville Guard isn't running a story about the 14 yr old boy that died at White River Medical Center. He died from being over medicated by a nurse in that joke of a hospital. Just like the guard trying to cover up a story that might hurt the med. center. And the child went in with an infected finger....yep and now sadly he's dead.

What in the world are we doing putting up with School Board members that put their egos before the education of our children. Judge Fox has told them three times that they are in the wrong and yet the choose to waste thousands of dollars on lawyers and not on fixing schools. The School Board does not have the welfare and education of the children in mind, they are paying their lawyers big money from our school's budget and getting bad advice. We the people DEMAND THAT THE SCHOOL BOARD PRESIDENT, VP, MR. Gililland and MS. Williams RESIGN!
