Technicality Leads to Release of Man Charged with D-U-I

The Pulaski County prosecutors office and Mothers Against Drug Driving say he should be in prison. Already convicted of misdemeanor negligent homicide and drug charges, Benjamin Swindoll is a free man tonight.

This is what is wrong with our society today/ the court system in unjust/ they are a bunch of crooks who judge us.

Seriously, this kid has a big problem if he could actually kill someone drunk driving and go out and run down 630 at 119mph drunk again. Go to any AA meeting and recovered alcoholics will tell you the number one thing that got them sober was consequences. Rehab did not work, it is time for jail.

Forget the technicality we're stuck with now. The original problem occurred when a 10 year sentence was reduced to 9 months because the person agreed to enter rehab. What system allows that? You pull out a gun and shoot someone even when drunk and you'll go to jail for more than 9 months. But apparently you do it with a car and you get 9 months of rehab. Please, legislators, forget filing bills to keep stores from using plastic bags. How about a law requiring those convicted of DWI + manslaughter to FINISH their sentences AFTER rehab???

This only confirms that you do not have to have a very high IQ to be an attorney or a judge. They have NO common sense!! Stupid breed of individuals.

I'm confused what it matters if he signed a piece of paper that told him he wasn't allowed to drink and drive (gee he already KILLED someone drinking while driving) upon his release. He wasn't of legal age to drink then and he isn't now-- but he has to legally be told??? I will work for free to help find this 'lost' document... It's obvious the young man cannot manage his life on his own--lockup for awhile might be his only chance for change.

My cousin and her grandmother(on other side of fam; not related to me) were both killed on September 21, 2008 by a 19 year old. My cousin was a 14 year old that had alot going for her. She was in 9th grade. The guy that hit them was first said to be drunk. He was on his way back from Heber and apparently "fell asleep at the wheel." Yet, a whole cooler of beers were across the highway. They said he had been drinking but was not "drunk." But they didn't do the breathalizer right away. This guy got a 2500 dollar fine and a year in COUNTY jail. Today, he walks free just to do something again. They might say he wasn't drunk, but in my heart, I believe he was. This story makes me sad for the family of the girl that was killed and angry at the law and the guy that keeps breaking it. Throw him in prison where he belongs!!!!!!!!
