Trial to start for man in Ark. officer's death

LITTLE ROCK, Ark. (AP) - A man charged with fatally shooting an Arkansas police officer last year is expected to go on trial for capital murder this week.

Prosecutors are seeking the death penalty for Jerry Lard, who they say killed Trumann police officer Jonathan Schmidt in April 2011 following a traffic stop.

Jury selection is slated to begin Monday in Paragould - about 35 miles from the small Delta town where witnesses told The Associated Press Schmidt heroically pushed a fellow officer out of harm's way before he died. Lard is also charged with attempted capital murder for shooting at the other officer, Corey Overstreet.

Lawyers for Lard, 38, wrote in court filings that they plan to argue he has a mental disease or defect.

His attorneys and prosecutors declined to comment ahead of the trial because a judge barred them from talking publicly about the case.

Lard's trial comes after the state Supreme Court last month threw out Arkansas' lethal injection law, effectively leaving the state without steps to execute any of its death row inmates.

Lard's lawyers said the high court's decision should pull the death penalty off the table in Lard's case, but Circuit Judge Brent Davis ruled that the high court didn't strike down the death penalty.

"The fact that there's this question about how the person will be executed should they get the death penalty ... that's a different issue from how this murder trial is going to proceed," said Felecia Epps, who teaches criminal law and criminal procedure at the University of Arkansas at Little Rock.

Authorities said Schmidt pulled over Keith Elumbaugh after a license plate check raised questions about his car insurance.

Lard was in the back seat. Elumbaugh told the AP last year that Schmidt was smiling and joking with the people in the car after mispronouncing Elumbaugh's name.

Then, when Schmidt opened the car door where Lard was sitting, Lard lunged at the policeman and started shooting, Elumbaugh said.

Schmidt, hit by a bullet, managed to get Overstreet behind the car and out of the line of fire, Elumbaugh said.

Once Overstreet was behind Schmidt's police car, Schmidt turned back toward Lard and began to return fire.

While he was shooting, Elumbaugh said, Lard was cursing Schmidt, saying "Die, (expletive)!"

"Please don't shoot me. Please don't shoot me," Schmidt cried out, Elumbaugh said.

Prosecutors said in a court document that Lard killed Schmidt to avoid an arrest in an outstanding felony rape case.

Lard is also charged with unlawfully possessing a gun and methamphetamine.

fed up; you aren't going to get anywhere with these three when it comes to the law; now Butch, he appears pretty well informed, and intelligent on posts that do not involve LEO's; but for some reason, he doesn't like the law at all; and the other two, forget about them, they hate LEO's for some reason. I'm with you fed up. And to the rest of you; why is the judge not allowing all the video from the dash cam? As he told the prosecution, some of the video would be "unduly prejudicial". What on earth does that mean! Wasn't it "unduly prejudicial" for Lard to murder someone?

"(who is NOT unsured)" What the hell does that mean? Did you read the article? Did you understand what you read? The cop stop them over questions about their insurance. They had insurance or they did not. NO LEGITIMATE REASON

I hate to tell you, "Dude III"....it is STATE LAW that anyone driving a vehicle in Arkansas, be adequately covered by insurance. You probably don't know anything about that. But again, if, by some fluke, you DO have insurance....you would definitely want the police to hold a person (who is NOT unsured) accountable if they hit you....

I get the impression the cop did not have a legimate reason to be harrassing them in the first place. Questions about their insurance, they had it or they did not.

Wow! Butch54 & Tired.."more to it than meets the eye"?!? What MORE do you want? Even the person who was pulled over gave an account of what happened. Officer Schmidt was acting professionally, even cordially. He was doing his JOB! He signed up obviously knowing the dangers, but I don't think ANYONE signs up for the negative, disrespectful attitude. Yes, it comes with the territory, but this YOUNG father/husband didn't deserve this! His FAMILY didn't deserve this. What a TRUE HERO, not only laying down his life for family, friends, community & the strangers who bad-mouth & disrespect him, but he went down saving another officer. I wonder... if, God forbid, someone batters, robs or rapes you, your family or your friends, who are YOU going to call on for help? Yes, that same person you doubt & distrust, the same one who may realize your disdain for him, his office, his badge. He will come to your aid, whether you like him or not, it's his job, his duty, his calling. What's the worst thing that could happen to you at YOUR job?? A paper cut, stubbed toe? These police officers go to work everyday knowing that it may be their last. Give them a break!! ArkansasYankee, I agree....these murderers don't care or even think about what is "humane" when they kill their victims, they don't consider the spouse, children, parents, siblings or friends left behind to grieve...why should WE care about how they meet their demise? This pathetic rapist needs to be put out of OUR misery.

What with all the bad publicity on the police these days it's hard not to wonder. Maybe there is more to this than meets the eye. I just hope they have clear and hard evidence that supports the case. Video our such. Today I wouldn't hardly believe a cop if he was blessed by the good Lord in my presence. If the guy is guilty hang him.

Let's see; a tweeker, a rapist, and a murderer. Yep, he's sick allright; but that's no excuse. Remove him from the gene pool; if we can't use the joy juice, then get a tree and a rope. And we still have other options; firing sqauds, chairs with juice, or do what Al did in Deadwood, slit his throat, and throw him in the hog pen! The officer killed had 3 children, and once saved a child's life. And what is it with the courts ruling against lethal injection; who cares how, or what's used to rid us of these kind of animals?
