You can refuse to let them see your phone and they have no way of proving it, unless the witness it as you are driving" You can refuse to let them see your phone, but they can obtain a copy of your phone bill through the Freedom of Information Act which shows the time of texts and phone calls or emails.

I am not trying to be funny and am just making a comment regarding my own observation, but it seems like there are more and more deadly accidents that involve trees lately.

It is already illegal in Arkansas to text and drive. The police have a very hard time enforcing it. You can refuse to let them see your phone and they have no way of proving it, unless the witness it as you are driving. I see too many people texting and driving, crossing the center line speeding up and slowing down, running on the shoulder. No matter what you think you CAN NOT I repeat CAN NOT text and drive safely.

Just about every one of these was a car leaving the road and going into the median. Are people falling asleep or are they texting??? I am not one to advocate for more laws on the books. I think government should be very small. But when your texting threatens the lives of my family on the road, I am all for it.
